Urgent help needed: Parkdirect UK appeal rejected

  • Thanks everyone. I submitted the appeal earlier in the morning today and received an email confirmation of the appeal having been submitted.

    Should I send an email information Parkdirect UK about it so that they don't transfer the case to some Debt collector and for them to cease any further mailing to me? Please advise as I don't want to start receiving any such letters? Or would this be counterproductive?

    Dear Parkdirect UK team,

    I have received your rejection letter to my challenge dated XXX. I have reviewed it and I have challenged your rejection and have filed the appeal with Popla on XXX, well within the specified deadline in your rejection letter.

    To avoid any doubt due to miscommunication, please do not do any of the following:
    • Send me any document purporting to be from the county court unless it is a valid claim form duly issued.
    • Send any “Further reminders” repeating your charge, your letter of XXX has been received and will be considered.
    • Write to me threatening to send bailiffs to my address without first issuing a court claim form and obtaining the court’s judgment.
    • Send me any standard form letters from your company or debt collectors, no debt has been acknowledged.

    As you have rejected my challenge and as I had specifically mentioned in my challenge dated 17th February 2014, I reserve the right to raise a claim for my costs and time against you at a court rate of £18 per hour. My costs are not exhaustive and will include stationery, stamps, travel expenses and any legal costs etc, and by continuing to pursue me you agree to pay these should I prevail.
    If you fail to follow any of the procedures outlined in the BPA AOS Code of Practice or your legal requirements under the Protection of Freedoms Act, or the requirements of the Practice Direction on Pre-Action Conduct then I will make a formal complaint to the DVLA Data Sharing Policy Group, D16.
    Please Note: Unless you have specifically requested it and received my express permission, you do not have my authority to disclose or refer this letter or any other communication from me to any other person or organisation.

    No need - if ParkDirect pass it to a DCA then they are breaking the BPA CoP. Once POPLA hand you a win it's all over ...... for good.

  • Dear all,

    I have received a letter from Park Direct now where they say that the conditions for keeper liability have been met and they said that i have 15 days to pay the fine else they will pursue it?

    How can they do it? I had appealed in time and i got the confirmation from Popla. (there letter is dated one day post the last date of filing of appeal) They have still sent me this letter and stressed me again.
    Hot Bring, doesn't it mean they have breached the code of practice also?

    as your appeal has already gone into popla, ignore the threatograms from the PPC and let popla deal with it in several weeks time

    if you feel the BPA CoP has been broken in any way, complain direct to the BPA with copies of all paperwork and letters etc , if you arent sure, complain anyway

    if not , let popla award your appeal and then the PPC will have no option but to cancel the ticket

    You are 'safe' from worry if POPLA have taken in your appeal. Complain to the BPA by email, always worth a complaint as you never know what sticky wicket an AOS member may already be on, close to sanctions or whatever. The more complaints the better - you are right, they are wrong and sent their letter too early.

    Complain to the BPA - the CoP states that actions need to be put on hold while a POPLA appeal is ongoing. Personally, when I've complained to the BPA I've always copied in the PPC at the same time just to show I mean business ( Capital2Coast hated it ;) ).
