Phones 4U

Hi

I was on an Orange contract which was due to finish August 14 but i had an upgrade date of February 15 so i started looking around. I was looking through Quidco when i seen upgrade offer with phones4u had a browse left my details and moved on.

However a week or so later i got a phone call from Phones4U asking about my contract and what was i looking for so i explained i'd like to go back to an iphone and offered me the iphone 4c on a 2 year contract and i could transfer my old number over.

I agreed to it all over the phone and got it delivered it said it would take about 4 days for my old number to transfer over this never actually happened and i ended up with a new number and then i checked my bank statement last week to find Orange were still taking money from me for my original contract.

I rang Phones4U up and explained i was supposed to have an upgrade and my old number transferred across which never happened and wasn't to concerned about it they checked my account details and was told it was a new contract they said they'll check the phone call and get back to me in 48 hours.

They never got back to me so i rang them up and my notes were checked and was told i did agree to a new contract in the phone call i told them i agreed to an upgrade not a new contract i then said you can have the phone back i'm not interested but because i've had the contract more than 7 days it can';t be cancelled i asked for a copy of the phone call to be sent to me but thats going to cost £15 i was transferred to EE and spoke to them about being mis-sold the phone so they are raising a complaints form and hopefully it all gets cancelled.

If it doesn't has anyone got any advice for me on what action i can take?

I hope this all makes sense and please no one use Phones 4 U there crooks.

    a couple of things dont make sens-u wouldnat have had an upgrade date in feb if your contract was up in the august not with ee/orange anyway

    you also wouldnt have had to transfer your number over with just an upgrade they just at the most send a new sim no need to transfer anything

    are you sure you didnt agree to a new contract

    Positive it was an upgrade and it did say on my orange account upgrade date feb even the contract from ee said service/upgrade agreement i don't usually agree to things over the phone but for some reason was caught off guard with this one with regards to the number being transferred across after the phone call i thought it would be done straight away once i received the new phone as i was going from a normal sim to micro sim i thought that maybe it could take a few days

    Did you tell EE you were upgrading? P4U cannot interfere or intercede your existing contract, only you can do this. Upgraded deals are worth less commission than new connections, so it is a no brainer for the shop.

    You now have 2 concurrent contracts. In your situation, learn - ask EE for a number port to your new phone 30 days before your old contract minimum term ends. This shuts down the old contract, and your number will then be on your new contract.

    Oh, and don't try this again - too much can go wrong!

    No i never told EE about my upgrade i stupidly presumed that P4U had sorted all this i'm going to speak to EE tomorrow and see if it can be sorted out don't worry will never try this again thank you for your help

    it just seems odd that u would get an upgrade nearly 6 months before the end?

    My Orange contract has an end date of 7/9/2014, with an upgrade date of 34/7/2014 and an early update available 8/3/2014

    Early upgrades are always chargeable whereas the one that is 45 days from the end of your contract is free (subject to potential device cost).

    Good news EE seem to have let me cancel my contract had nothing in writing but when i spoke to them on the phone they said they would but a complaints form in an cancel and today i lost all signal checked my EE account and it comes up with the following message
