    Hi All,

    I responded to their request for my name/phone number saying I am not obliged to give them it. They has since responded with the following:


    Thank you for your email.


    Without this information we are unable to process your correspondence.


    Please do not respond to this email without providing the requested information.


    Once 28 days has passed we will request the information from the DVLA and send a Formal Demand to the registered Keeper of the vehicle. As you refuse to provide the details of the driver on the date in question Under the Protection Of Freedoms Act 2012 the responsibility remains with the registered keeper as recorded by the DVLA.


    The parking Charge notice has not been put on hold.

    I presume now I should just wait for the formal demand and go through POPLA?

    Are you saying you didn't even give them your name (as registered keeper)? If you didn't, I'm not surprised at their response! :wall:

    You can hardly expect them to deal with a challenge if they don't know the name and address of the person challenging! It's the driver's name and address, and your 'phone number, you are supposed to be withholding from them. They'll get the keeper's name and address soon enough from DVLA so there's no point in not telling them!

    I can see what the problem is from looking at their dodgy online form which only asks for the driver's details, but if you want a PoPLA code from them you will at least need to tell them who you, the registered keeper, are! You could do that in the "Comments" field in the online form, or snail mail them.

    p.s. that online form is in itself worthy of a complaint to DVLA and BPA Ltd.

    Thanks for your response. I did give them my name/address, but I am not the registered keeper (that is my mother), but judging by the responses on this forum thought it best not to declare myself the driver?

    Shall I send them my mothers name/address as registered keeper, letting them know I was the driver? There is no way I am sending ym number though haha!

    (just to clarify I sent the appeal as a "keeper" of the vehicle, not registered keeper", so they do have a name/address for correspondence)

    Obviously we tell people to appeal as keeper, so it should have been written in your mother's name. Forward it again from your Mother instead, in her name, different email addy (you can do it for her, you could set up a gmail account in her name right now especially for dealing with this scam). Come on, think about it, you cannot appeal in your name, not saying who you are, you are a third party unknown to them! You are also in danger of missing the appeal deadline now. If you wait for the 'NTK' I suspect you will never claw this to POPLA as they will give any excuse to avoid it.

    The alternative is write back and tell them you were the driver. It's up to you, One of you has to appeal, saying who you are. They don't know you from Adam right now. If you'd rather keep your Mum out of it then 'come out' as the driver as you can still win at POPLA, no worries.

    Hi Again!

    Hoping for some more help on this one. With my mothers permission I resubmitted the appeal under her name, editing it just slightly to say that "As the registered keeper, I have been advised of your parking invoice and of your request of my details as registered keeper since the appeal was originally sent by Rob X (Me)".

    They have now responded with:

    Thank you for your email.


    As stated on the reverse of the Parking Charge Notice, all correspondence must include the drivers full name and address.


    You have indicated that an appeal has been submitted by Rob X, however we have not received the appeal that you refer to. Therefore could you please confirm the name and address of whom was driving on the day; without this information we are unable to investigate your appeal.


    Please note, we are unable to address general template letters in full (taken from websites such as Money Saving Expert etc) as they rarely relate to the actual parking event in hand; therefore please submit your appeal in your own words and only raise issues relative to your individual case.

    Any ideas as to how to handle these guys now? To me it seems that the points raised in the appeal are still relevant, whether it is a generic appeal or not.

    You can't decide what is an appeal, and you certainly don't need to know who the driver is, and as you are using keeper liability under pofa 2012, explain why that keeper cannot appeal in your world?

    Perhaps you missed the memo from the dvla that was passed onto you by the bpa? You are in breach of your kadoe contract with them and in breach of the bpa code of practice !
    “the following practices may be considered as Code breaches and must not be continued:
    • Asking the motorist to enter into additional correspondence to obtain a POPLA code
    • Failing to include a correct and/or valid POPLA Code within the Rejection correspondence
    • Issuing a POPLA Code with a date identifier which is significantly different from the date of rejection
    • Appearing to indicate that the issue of a POPLA Code is conditional on driver details being supplied “
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
