Hi All,
I got a PCN back in Feb as the machine was broken and i didn't have a card on me to pay online, so i appealed using the template on the newbies page.
This is what i sent them in the first appeal

As the registered keeper, I have received your parking invoice which of course, I decline your invitation to pay. I wish to invoke your appeals process, since all liability to your company is denied on the following basis:
1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner.[/FONT]
[FONT="]2) The Paying Machine is not in working order.
Please issue your standard cancellation letter or a specific, detailed rejection letter. If you choose to send the latter, it must state:
- the legal basis of your charge (i.e. breach, trespass or contractual fee?) [/FONT]
[FONT="]
- if alleging breach of contract, with your rejection letter I require a breakdown of the liquidated damages suffered, and by whom, and when this calculation was determined and how this particular 'loss' arose. Please also explain how/why you charge a fixed sum no matter whether the alleged contravention was trivial or more serious and how that can amount to a genuine pre-estimate of loss.[/FONT][FONT="]

Following your rejection of my appeal of the above PCN, BPA rules clearly state that you should have issued a POPLA code. You have failed to do this.
You should now either cancel the charge or provide the code by return. No further correspondence will be entered into and you will be reported to the BPA and DVLA for breaking the BPA Code of Practice.

An increasing number of PPC's seem to be trying to weasel out of giving a POPLA code (as it costs them money) and trying to induce people into paying by extending the discount period etc. This is especially the case when they see a forum appeal or an appeal mentions no genuine pre-estimate of loss as they know that this is another case they will lose at POPLA.
Send a complaint to the BPA (contact details are in the Newbie sticky thread) as well as the suggested letter to UKPC.0 -
That is quite shocking that a PPC can blatantly write a reply to appeal without a POPLA code or even a mention of your right to one. Happens all the time, but that doesn't mean you shouldn't email a complaint to the DVLA and BPA, costs you nothing and more complaints have more weight!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I used to work for ukpc but resigned because of the dirty tricks they want me to do to obtain tickets.we were told when taking pictures of cars that park in two bays to take the photo at a certain angle to make it look worse. Also we were told to issue ghost tickets. This means issuing the ticket. Taking a photo of it on the windscreen then removing it. The driver is then unaware of the ticket and loses any appeal due to not paying within the set time. We were also told when issuing a ticket for not displaying a blue badge that we must make sure we don’t get the blue badge in the photo even though we can see it on the passenger or drivers seat. By doing this the driver has less chance of winning any appeal. As crazy as it sounds. UKPC have a strict company rule. They tell all wardens never to ticket a car if it has Irish or eastern European number plates. It costs them to much money to trace them through DVLA. However to obtain keepers details for English number plates through DVLA only cost them £2.50 for each request. DVLA make millions from private parking. Another favourite for 'making money' UKPC are placing tickets on cars at hospitals at Southport and Ormskirk - nobody is there because they want to be, even the visitors would much rather their friend/relative weren't in hospital and yet every day numerous tickets are handed out and paid because people don't know they can't be enforced. UKPC WARDENS are paid a bonus which works like this. first 20 tickets zero bonus. 20/30 tickets 2 pounds per ticket. 30/40 three pound per ticket. 40/50 four pounds per ticket. 50 upwards five pound for every ticket issued0 -
Whilst all this information may appear to people to very "so interesting blah blah blah"
What people might not realise is the following:
1. Our friendly ex ukpc warden set up a facebook site called "dont pay your private parking ticket".
2. Our friendly warden telling people to ignore tickets,
3. Advising someone who had a default judgement against them to ignore it and that it should be put down the toilet. I then corrected his advice and other peoples p*ss poor advice on there. Ukpc warden then responds to this by banning me.
4. He accuses me of having a vested interest in a parking company and that my advice should not be trusted.
5. After i correct his advice and someone elses he tells someone they should hold out on the default judgement and pay £1.00 per month
6. Luckily I find this guy, phone him up and give him the low down on what he needed to do. I told him to pay up, otherwise his credit rating would have been affected and he had ignored the court papers
7 And for doing the above i got banned from his "little group"
So it may seem interesting to be told the above, but this guy now thinks he is gods gift to people with parking tickets and will not accept that other people know a lot more then him.
The fact he used to issue tickets doesn't mean he knows what he is talking about. Yet the way he goes on you would think the sun shines out of his.....Proud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0 -

I am all for free speech. BUT Today I have removed three people from this forum because after investigation I have been told and seen that people who have a vested interest in a private parking company join these forums to scare people to pay their tickets. this is how these scum bags work
