    Great that's what the OP needs to read.


    Arguing this case further down the law, they need primarily a legal argument to rely on.


    Which is then backed up by the code for housebuilders which should fill any gaps not covered by legislation.

    I hate injustice too, so good luck OP in pursuing this.

    I am horrified that they feel justified in keeping the full amount. To my layman sensibilities, that just doesn't seem right nor fair, especially as you changed your mind very quickly.

    I hope you kick their as* in court!

    I Totally agree and as the OP i am seriously touched by all the kind words and advice that has been given - i am intending to fight all the way so my N180 form is going off tomorrow with a further £55 to continue ( can understand why people give up tho) and will keep you all posted

    well i've got my court date now - 25th September. I have to get all my evidence together now to present to the judge. The defendant said no to mediation but we said we would and the letter we have had from the court with the court date has suggested that we go for mediation first but if not - the court date is set so any advice for what to put in my evidence file would be much appreciated and what do you think about the mediation? Thanks everyone!

    Courts are usually not impressed by people who refuse mediation so continue to say you will go.
