Dealer Won't Return Deposit - Outstanding Finance

You buy a car from Arnold Clark and they have not checked for outstanding finance the car is yours, they have a problem though.
I'm not buying from Arnold Clark...I'm buying from Border City Autos in Carlisle (England). It seems Arnold Clark sold the car at auction and BCA bought it from there. Santander currently hold an interest in the car, for the past 3 weeks Border City Autos have been telling me they will sort it, with no joy.0 -
If BCA bought it at auction then they have clear title.0

After chasing Santander I have received an email this morning from them saying 'I can confirm we are still chasing out customer, and once received will update our systems.'
I've told the dealership this has gone on too long and I would like my deposit back.0
