the tenancy agreement say anyone who wants to move in needs to be added to the contract (and pass references).

If you don't care about being evicted (which can't happen until the end of your fixed term) then you have nothing to worry about, violate your tenancy agreement all you like! As long as you don't cause damage to the property then nothing can be deducted from your deposit. The primary downside is that the agent/landlord won't give you a good reference in future.0 -

Why not just let him move in, he pays everything to you for now, then three or four months down the line, get him to apply again.
Obviously this would mean big part in your case to put other tenants off and hope they won't visit.0 -
Next time they talk about the law you should say "I'm sure you must know what you are talking about. Please show me which law says this"
As far as your deposit goes as long as it is protected you are in a strong position. You have had the require documentation to show this?
No letting agency can "fine" you for anything.0 -
thanks giraffe, but on the contract there is a list of fines and other charges for minor things, including a moving out fee and so on.
I am worried about them taking a bunch of money from the deposit and quoting these parts in the contract.
if i did not pay my last months rent and let them take the deposit, wud that get me into further trouble?0 -

A few things to check:
Is your deposit protected in one of the schemes as required by law?
Were you given the prescribed notice within 30 days?
Were you given a dual signed inventory when you moved in?
And to add that they cannot "fine" you. These are "unenforceable" conditions in the contract. If the deposit is protected, then the scheme will not allow the Ea to make these deductions.
They may be able to charge you a moving out fee if that is in the contract but they will charge that whether you have a lodger or not.
Is there a housing advice centre near you? Because you need someone to look at a copy of the contract and tell you what is legal and what is unenforceable.If you've have not made a mistake, you've made nothing0 -
