Vodafone and Bryan Carter Solicitors

Hi sorry i may have posted this in the wrong place. A two years ago while i was in my second year of uni i had a phone on contract with vodafone. Around the summer time the phone was cut off for two months for no reason. I hadn't missed any payments or anything. Then when they put the phone back on they charged me double for those two months saying i had gone over my limit in that time. After trying to sort it out i paid and then did not renew the contract as it had almost ended. Now i have received a letter dated 27th of March 2014 from Bryan Carter Solicitors claiming that they have been trying to contact me and i owe then £164.79. This is the first i have heard of this. The contract came out of my mothers account and was in my name but was paid off in full at the time. My mother is disabled and i can't afford this. They said they would put the account on hold for 14 days while i gather evidence to prove that i paid this but this happened two years ago and neither me nor my mother can find anything. I don't live with her any more. I can't afford a CCJ as i am getting married and want to be able to start a life, plus this is completely wrong that they are harrassing me for money. Could anyone offer any advice on what to do next please. I would greatly appreciate this. Thank you in advance.

    The contract will reach a minimum term after which you must cancel or they will continue ....if you did not cancel the debt will be correct

    If it was in your name then your Mother has nothing to worry about.

    There won't be a CCJ but they will trash your credit rating for the next 6 years and will already have done that most likely

    Firstly your contract NEVER ended. It is a minimum term, not a fixed term. If you wanted the contract to end you should have explicitly cancelled it. So from VFs point of view the debt is legit. You never cancelled the contract, it continued but you stopped paying for it.

    Given that it was just two years ago it's perfectly possible to obtain copies of the relevant payment from your bank or credit card. I would do that urgently (it's not credible that you can't). Then continue to respond to Vodafone but also contact the Web Relations Team as instructed endlessly on the Vodafone complaints thread on here. If you are correct and have an honest case they will sort it out for you.

    IF you are correct and "paid the fee" to cancel the contract it would have been a LARGE one, since you would have needed to pay the full cost of running the contract for the remainder of its minimum term. I am, in fact, surprised at such a small figure which is being demanded. Maybe there was a small amount for use on a final bill which was unpaid and interest/costs have been added. Vodafone should be able to give you precise details of what (according to them) you actually did and paid. You will be in a far better position to establish the exact facts when you have that. In any case, since it is a solicitor and not a debt collector it's not certain that you won't end up in court. Although that is unlikely they may have already trashed your credit report. You can check that by paying about £3 to each of the credit reference agencies before applying for a mortgage (or another mobile contract etc, for that matter).
