(late) appeals letter to smart parking or debt recovery plus??

    At this point just ignore everything. Smart Parking are smart enough not to do court and in fact won't do POPLA if you quote pre-estimate of loss, contracts or any other requests for justification.

    Bear in mind that Smart 'Notice to Keeper' letters do not invoke keeper liability under POFA 2012 so they can only aim the charge at the driver. Kaytata, this is an urgent suggestion - I would now edit all posts above which give away who was actually driving. Not that Smart Parking do court, as so far, they don't.

    But keep ALL letters in a file just in case and I would indeed send a late appeal as keeper, online (don't waste a stamp, just email the first part of the appeal template from the NEWBIES thread) and an email complain to Asda Head Office, and/or just march into the store with various Asda receipts and all the letters and stride to the CS desk & demand to see the Store Manager (not a Duty Manager). Dress smartly like you mean BUSINESS and do not be fobbed off with any lie about 'we don't own the car park, not our problem' = NOT TRUE). Don't discuss this with anyone who fobs you off and make sure they know you are a customer who is now put off ever shopping there again.

    hi all, just to let you know i sent off the letter to smart parking and have received a response cancelling the PCN

    for those who ignored yellow sticker on window + 3 letters, like i did, it is worth sending the appeals letter even if its after the intended court action letter from private parking companies - its never too late as iv found out

    Well done - nice update! Smart Parking always cancel when they see a template forum appeal that susses out they have no case. Even if you send it late.
