(late) appeals letter to smart parking or debt recovery plus??

having seen loads of people under fire for asking silly questions, have been trying to search the forum to find the answer for this "silly question"
I got a fine stuck on my windscreen in asda back in jan, i didnt realise advice had changed and ignored it. subsequently got a ntk from smart parking in feb, and then two letters from debt recovery plus - most recent a notice of INTENDED court action and to pay by 15th April...
having missed all appeals dates, im tempted to ignore and hope it goes away, but have decided to send the letter in the newbies thread:
i went into asda three days this week and the lady wouldnt do anything to help despite explaining its their responsibility to cancel,
BUT i cant figure out whether i send the letter to SMART PARKING or debt recovery plus?

Dear {company name of this member of ''PPC World''},
PCN number xxxxxxx
As the registered keeper, I have received your parking invoice which of course, I decline your invitation to pay. I wish to invoke your appeals process, since all liability to your company is denied on the following basis:
i went into asda three days this week and the lady wouldnt do anything to help despite explaining its their responsibility to cancel,

Hi kaytata,
Who was the recent notice of INTENDED court action from?0 -
original ticket from smart parking
letters for payment and intended court action from debt recovery plus0 -
Complain to asda head office , attach receipts to the email. You should know though that smart have not done court to date, and I mean ever! Debt Recovery Plus will not do court either as this alleged debt is not theirs, and despite everything said by them it's all bluff and lies. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

soo the advice is to ignore or go ahead and send the "late" letter?0

Well you could send the appeal in post one of the sticky thread by coupon mad, it's never to late to appeal, the time limits are the parking company only, so there is no harm in doing that. But it's not going to be allowed.
Can I ask though are you the registered keeper, and was the RK driving ?When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

No harm in trying the late appeal, but they are under no obligation to accept it - if you decide to send it - send it to Smart Parking not DR+.
Your best chance of getting this cancelled is the route Stroma advised i.e. Asda head office - there is a web site
w w w . c e o e m a i l . c o m (take out the spaces - can't post the address)
in which you will be able to find the email address of the Ceo of Asda
Also have a read of the two sticky Newbies #post 4 on dealing with debt collectors

and crabmans thread for the link to what to do should you within the next 6 years (highly unlikely btw) receive a letter of intended court action from either Smart or a solicitor acting on their behalf

Edit: apols for the crossover Stroma0 -
I think the reason Stroma asked you those questions was in case you might be able to reset the clock by naming the driver but even if you weren't the reg keeper and the driver that option has now gone anyway because this was initially a windscreen ticket0

I've fired off an email to asda ceo, also the store manager of the store im dealing with.
and will also send the letter to smart parking today.
Hopefully will go away.0 -
No point doing something that could have serious consequences and especially not for something as unimportant as this.
It more than likely will all go away - as Stroma has said they have never yet taken anyone to court. Obviously no-one can say they never will.
In the meantime you're doing all that you can for now to try to get this out of your hair0
