    Hi All,

    So received my letter and photo of visitors permit from the residents and have included it along with a letter I have drafted. Thanks for all your advice I have included all the phrases and key terms you suggested.

    Dear Sir/Madam,

    I am writing for a third time in reference to an incorrectly issued parking fine issued by one of your wardens. A letter received from yourselves dated 28th April 2014 is requesting that I provide you with a copy of the visitors parking permit which I held at the time of the alleged infraction.

    Enclosed within this letter you will find a copy of this visitors permit along with a signed letter from the issuing resident with whom I was visiting on the date in question. The vehicle FV** *** was fully authorised and allowed to park in the Bingley Court car park at the time of the incident. At the time the ticket was wrongly issued I held an agreed verbal contract with the owner residents of *** Bingley Court who authorised me and the vehicle to be parked within the allocated spaces.

    With this information in hand I am glad to note that now you should realise that you have no option but to make a final decision on this matter. I have been waiting over 5 months for this issue to be resolved and have repeatedly complied with your various requests and process’s. Throughout this time you have repeatedly sent letters out to the wrong address after being issued with the correct driver details. You have had long delays in between correspondence some as long as 6 weeks in between.

    I would like to take this opportunity to request for a third time the issue of a POPLA code in relation to this case. You have withheld this from me after numerous requests from you in writing and over the telephone. With the information I have provided you time and time again it is evident that you have no legal case for this charge as it is not a genuine pre-estimate of any loss incurred.

    I would again urge you to make a final decision on this case and one that see’s you cancel this wrongly issued ticket as you can see that I had a permit and was fully authorised to park by the verbal contract in place between myself and the resident. I advise you to cancel this “ticket” to save yourself failure and incurred expenses with POPLA should you wish to take this case to them, as I am prepared to do.

    Hopefully this will work out for me but if it doesn't and they do want to take things further this letter should have covered me.

    Until your boss names you as driver they can legally completely and utterly ignore you.

    Get your boss to write or e-mail giving your details as driver.
    This should generate your own Notice to Owner / Driver and you can re-start the appeal.
    When appealing always head the letter in BLOCK CAPITALS ;
    SERVED NOTICE OF APPEAL - CERTIFICATION OF POSTAGE OBTAINED -

    However until you are named as driver they can and will ignore you as your boss remains liable under POFA.

    Thanks for the advice but looking at the thread you will see that this is the last letter that I sent on behalf of my boss. "He" wrote into them naming myself as the name address and giving my address as the named driver.

    So, this is the second letter I am sending into them after their returned correspondence, still to the wrong address which my boss gave them.

    I am reluctant to just ignore letters ad I have read that this is no longer the thing to do. Similarly I feel that all this miscommunication and sending letters to wrong people, wrong address's etc and long time gaps can only be in my favour should this end up going to a court or POPLA. It goes some way to proving their incompetence.
