UKPC Parking Charge Help

So I have spent the last day reading all over this forum and have started to become very confused and daunted by the whole process. I am very close to just paying the parking ticket as I really can't afford bad credit, CCJ's etc etc.

However, in a final bid I thought I would post my situation and seek the advice of the knowledgeable community here.

I received a parking ticket (apparently as I did not have the pictured yellow notice on my vehicle when I returned to it) on New Years Eve/Day whilst parking my company vehicle at a friends house (flats). I had been given and displayed a visitors badge by them but still I received the ticket. They have quite comprehensive photo's and the small red V is not that obvious. However, I believe it to be on the left hand side of the windscreen, fallen lower down (you can see some white paper).

I have logged into UKPARKINGCONTROL and seen the images I will include them in this post.

I appealed via their on-line system on their website with a letter given to me by the flat owner I was visiting and an image of my vehicle taken on my phone. This was on the 24th Feb 2014. The next correspondence I hear from them is on 03/04/14 stating that I still need to pay the £100. Having rung them up they said that my appeal has been unsuccessful and that I need to pay still. I stated that I made an appeal on 24th Feb and wanted to know the outcome. Apparently they have sent me a letter in between the 24th Feb and 3rd April asking to see evidence of the permit - however I have never received this letter (they obviously don't believe me).

I subsequently asked for my POPLA code to which they said one has not been issued. I was lead to believe that if an appeal has been rejected they need to issue one of these? I am starting to doubt if they ever received my original appeal as an initial person I spoke to at UKPC said there had been no logged appeal - but the second person said there had and that a letter had been sent out (one I never received) but at the same time no POPLA code.

Anyways, the women advised me to re-submit my appeal and then they would look at this second one. If that was unsuccessful I would then receive my POPLA code. I am in the process of writting my appeal letter but at a loss as to what to put in it. Bellow is the original appeal that may or may not have been logged on their system followed by the letter I am currently drafting.

Any help would be greatly appreciated as I genuinely had permission, visitors permit and cant afford to loose £100 but at the same time am under pressure from my employer to resolve this. HELP!!

I am writing to appeal this parking ticket for a second time. Having looked at your own supplied images you appear to indicate that a yellow sticky notice was attached to the drivers vehicle. The driver of the vehicle has never received or seen a yellow parking permit as imaged in your photo’s. It is entirely plausible that this had been removed by a third party prior to the drivers return to the vehicle. This being the case the driver has been first made aware of any parking notices by the first letter that was received towards the end of January – early February. The vehicle is a registered business vehicle and the process of passing paper work to the driver at the time can take some time internally, as such allowances need to be reasonably accounted for.

The driver initially appeal the first letter that was received in mid-February (~24th) via your online appeals platform. At this time he has informed us that he had a valid visitors permit from residents of Bingley Court and provided a supporting letter from said residents. With this evidence in hand we feel that the parking notice has been un-justly and un-fairly issued.

Having been in telephone contact with your staff we have been advised that this original appeal has been unsuccessful. The grounds that have been explained are that you wrote to the above address for a second time in March requesting for a copy of the visitors pass in question. Whilst the driver is happy to provide this, the letter requesting this information has never been received by either the driver or the registered business. Could you please provide proof of postage and receipt of this second letter requesting the aforementioned supporting evidence. Being made aware of this second letter that allegedly got sent to the above address and any possible imposed time frame passing, the driver of the vehicle has requested from your staff a POPLA code in reference to a failed appeal. At this time the driver has been made aware that no such verification code has been issued or generated.

Your staff have instructed the driver of the above vehicle to put a second appeal in writing rather than via the online system as this was the more reliable option for appeals. Having almost 4months passing since the issuing of this parking ticket which was originally issued illegally and with the supporting evidence from the residence and drivers images we urge you to revoke this parking notice.

To summarise the points are as follows:
• No original “Yellow Sticker” notice was received
• The driver had authority to park from residence
• The driver had a valid visitors parking permit
• The driver appealed in a timely manner in line with your guidelines
• No letter requesting further supporting evidence was ever sent or received by the business or driver
• When requested a POPLA code this has been denied on the grounds of no appeal being registered when one clearly has through your online system

If you choose to pursue me please be aware that I will not enter into any correspondence and this will be the only letter you will receive from me until you answer the specific points raised in my letter.

Any help, guidance or advice you could offer someone in my position would be greatly appreciated. I really don’t feel that this is a fair ticket and I really don’t think I should pay.

    try not to admit anything that did or did not happen , or who did it

    there is a NEWBIES thread stuck to the top of this forum that has a flow chart in post #9 and various info telling you all you need to know

    so yes they should issue a popla code if they reject your appeal

    then when you get it, look at that newbies thread for links to examples of popla appeals , also checking the code is valid and the expiry date too

    the main thing here is to appeal, and get cancellation or a popla code

    Could some one please advise me on this issue:

    I am the driver of the vehicle but not the registered keeper. The registered keeper is a company (my boss) and so far he has been passing on these letters to me to deal with.

    Should I send a letter to the UKPC stating that all letters should be passed on to me - and give my details or not?

    The problem I see is that I cant write a letter as the registered keeper as I am not. I guess they do not know this: According to the Newbie Sticky there is a paragraph that says:
    This is especially recommended where it was a postal PCN BUT the keeper has ignored it and missed the appeal window - but the driver will never yet have had the 'chance' to appeal due to the lack of a windscreen ticket. A good plan is to give a different postal address for the driver, and state that you have NOT passed the paperwork to them so the PPC will have to write to the driver with a Notice from scratch.

    Technically I have received the paper work and placed an appeal in on their on-line system, however, they do not know that I (driver) have received the paper work or that it was me making the appeal (as on-line) and two I am doubtful if they have received this on-line appeal at all.

    So should the first registered letter I send in be one saying/pretending I am the registered keeper and not the driver and passing on the details of the driver (me) or should I use the appeal template?

    you can do both if you wish

    the RK should send them the simple template letter stating the drivers name and address, absolving them under POFA 2012

    you can amend the template letter and appeal as driver once you have the PCN in your own name, or can do so anyway

    its still about obtaining the popla code and in this case your "boss" should have replied to the first NTK naming the driver as its a leased or company vehicle , then the driver should have appealed to the new PCN once received from the PPC that is in their own name

    I am sure this is explained in the newbies thread where its a leased or company vehicle, the advice you have read is aimed at private individuals like myself, with a private vehicle and more than one driver, but only one RK

    PS:

    I have drafted this letter in anticipation of a response. To clarify this is the situation currently:

    1. No Yellow Sticker was on vehicle even though pictures show this to b there

    2. First letter sent to registered keeper (our head office)

    3. Letter hand given to myself (driver)

    4. I logged into their online appeals system and attached the letter and pictures from above (my first post)

    **** Thought this was over as gap of about 2 months****

    5. Next letter received to registered keeper (our head office)

    6. Second letter hand given to myself (driver)

    7. I phone up and one operator at UKPC says they have not received an appeal, another operator says they have received an appeal and that they wrote to me asking to see further evidence. When I did not respond to this letter (I never received it) they re-sent the letter (letter number 2) and that I automatically failed in my appeal as I didn't respond in time or provide evidence of visitor pass in question - (as mentioned never received this letter)

    8. At this point asked operator if my fail has been unsuccessful please can you provide me with my POPLA code - they state they do not have a code for this case and one hasn't been generated and that I should lodge a second complaint in writing this time. If this one was unsuccessful then I would receive a POPLA code.

    9. I come to this forum for help :)

    My understanding is that if they have already served a 'Notice to Driver' (the ticket stuck on the windscreen), then they do not have to allow the driver a route of appeal when they are named following a Notice to Keeper.

    Realistically, the fact that you didn't see the Notice to Driver (try to call it what it is, as your appeal tends to fluctuate between calling it a 'yellow permit' or 'yellow sticker' etc, it is only yellow as that is the envelope they put it in, it's what's inside that is important) is mitigation for the DRIVER. If you are appealing as the registered keeper then it doesn't really matter. If your company is happy for you to use their name in the appeals then appeal using the template in the newbie sticky thread. If they aren't then use the same appeal but change it to read 'the keeper' rather than 'registered keeper', as POFA only refers to 'keeper' it doesn't specify whether this is the Registered Keeper or just the Usual Keeper.

    Get this appeal in before you go worrying too much about what could happen. The most important thing is to get a POPLA code out of them.

    Thank you for taking the time to reply. I have subsequently sent off the last letter from the registered keeper "my boss" informing them of the "keeper" of the vehicle (myself). I shall await to see their response.

    I have also ask the owner of the property to aggressively chase up their property management company to try and get the notice removed that way.

    Hello all again,

    Sorry it has been a while since my last response but I haven't received anything until today from UKPC. I am willing to fight this all the way but need to make sure I am following things correctly in order to maintain the boards 100% success rate.

    So I have received in a round about way two letters. One has gone directly to my employer again. Even after the last letter that I sent indicated someone else (me) as the driver and the correct correspondence for me. This letter is a final demand letter for £100 dated 22/04/14 for parking in a permit space without displaying a valid permit.

    The next letter I have received is addressed to myself but still at my work address rather than my home address - which is the one I put on my letter. The only place I can assume they have got this address from is the original online appeal I made right at the beginning.

    However, this one states that I need to provide a copy of the parking permit within 14 days and the case has been put on hold and the fine reduced to £60 until they make their final decision.

    So my question is where do I stand?
    Which letter should I acknowledge?
    Which letter should I respond to?
    How should I respond?

    I am in the process of getting a picture from my colleague of the parking permit, coupled with a signed letter from them as residents and I was going to send this off to them in reference to the letter dated 28th April 2014.

    What are your thoughts, is there any legal stuff or certain phrases I should be including.

    Yes, as you say just send a copy of the permit & the letter from the resident stating your car is authorised to be parked there as you have an 'agreed verbal contract' with that resident who is allowed to have a car parked on site. State that you are glad to note that they realise they have 'no option' but to...eventually...make a final decision which is what you have been waiting for all this time, along with your POPLA code, seeing as they have no case with a charge that is not a genuine pre-estimate of any loss. Finally invite them to cancel the pointless 'ticket' to save another failure for them at POPLA at their expense!
