Estate Agent lied before we put in a offer! Not Happy!

  • Wow, I am meeting a tree specialist on Thursday before we sign the survey paperwork, if he says it's a big issue then I'm going back to the Estate Agent and vendor.

    If that's the case, then this particular EA needs to be exposed as someone who takes on staff that are as thick as two short planks. It's their job to know such basic info. I would certainly sack anyone who worked for me that didn't know things at that level even.

    I would have said that that level of knowledge from a person in that job is O level standard knowledge to have (not degree level standard) and that's judging by 21st century standards.

    Who an estate agent employs and who they should employ are two separate things, unfortunately.

    I don't but when we have asked twice and been assured twice, I guess I am naive yes? I am not a tree surgeon either and it took me one phonecall to find this out so why didn't the EA do the same as they knew my concerns! I await a response from the EA to get a way forward on this. If they had told us up front there is no way I would of agreed with my wife to offer on it.

    If you believe anything an Estate Agent says then yes you are naive. It is probably precisely because they knew your concerns that they told you what they did, as otherwise you may have pulled out of the sale. I bet they didn't put it in writing did they. Good for you for checking it, and getting a tree surgeon in to look at it. Change your offer or not according to what they say.

    The house is great as is it's location so I am hoping the tree surgeon gives me positive news, however if not then I will be going back to the EA and it will be over to them.

    Do not kill the tree.

    Anyone who commits an act in contravention of a TPO is liable, on conviction in a Magistrates Court, to a fine of up to a £20,000. For a serious offence, a person can be committed for trial in the Crown Court and if convicted, can be liable to an unlimited fine.

    This thread will get you convicted no problem.

    Your best bet is to get an expert to tell you if it's dangerous. If yes, apply to cut it down. If no, don't worry and enjoy your tree, I think it looks lovely.

  • Yes met the tree surgeon yesterday, he gave me very positive news. The tree is a Scotch Pine and around 80years old, the houses were built around them so the foundations will of been built to withstand these trees. He said the reason the tree leans is because of the way it has grown towards the light? Anyway he said he would have no concerns about it and the best thing to do is monitor it, if we see any movement towards the house or ground movement then we can apply to the council for it to come down, he did say if there is any danger of the tree moving then it's classed as dangerous and there is nothing the council can do to stop us doing work on it.
    All in all I am happy and my concerns have been put to rest.

    If you do then do as you like .... if the wife rules the roost then buy it and keep your mouth closed - whilst spilling some paraquat around the roots (that's a joke, I'm not suggesting you do something illegal) :D
