  • I have had loads for alleged breaches at the same location. Sent them a one line saying that I didn't recognise their authority to issue invoices. The rejected my "appeal", so I took them to PoPLA for the hell of it. The appeal was so strong that they withdrew before the PoPLA hearings. Don't worry about it. Take them to PoPLA by doing your homework on here, or ignore. As stated, it's possible, but highly unlikely that G24 would take you to court.
Search my post " PoPLA evidence - What to submit" on what is a good defense for a PoPLA appeal.

The catch being that Mini1 has missed the G24 deadline for appealing so they are unlikely to issue a POPLA code.

Mini1 - your options are to ignore while complaining to the landowner or try a late appeal. If you decide on the latter then try this email to G24 :

    Dear G24,

This is an appeal against the charge issued to the vehicle with the registration XXXXXX, charge reference XXXX.

It is the registered keepers assertion that :

    1. The charge is not a genuine pre-estimate of loss.
    2. The signage does not conform to the BPA CoP to which G24 has committed.
    3. G24 has no authority to issue charges over the land in question.

As such the charge is rejected. You should now either cancel said charge or provide a POPLA code for the registered keeper to appeal to the independent adjudicator.

The Registered Keeper understands that this appeal is outside your arbitrary imposed timescales for appeal but you may wish to save yourself some money and effort as the Registered Keeper will not respond to any further correspondence. Your authority in this matter is not recognised nor accepted.

Any further correspondence other than confirmation of cancellation or a POPLA code will be considered harassment and could result in legal action being taken against you.

    Yours,

    Print name ( don't sign ).

I haven't told the retailer because this happened in December and I didn't start getting letters till February, so I thought it would be irrelevant to try that now. But I guess I could go in, I've heard that once it goes so far though the retailer cannot do anything though.

You seem to be looking for excuses to pay when all you need to do is to ignore a few letters, it's not difficult.

Hmmmm...so before posting, when you read the sticky threads up the top, including the ones collated by Crabman, there was one called 'Successful Complaints about PPCs'. Choc full of people who got their cases cancelled by retailers after complaining...often six months or more after the event. And you reckon a few weeks is too late?!

Also in the NEWBIES sticky thread it tells you to complain to the BPA if your appeal wasn't handled properly - you should complain if this PPC only gave you 14 days to appeal seeing as they have to offer 28 days. And if they never sent a NTK/PCN at all.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
