Surely if the OP acknowledges the debt, the smart thing is to call up whoever's servicing the debt at the moment, ask for a figure of what is owed, and assuming it's correct, start paying it?

Ok thanks for all the input it is taken on board.

I couldn't give them a new address when i moved out as i didnt have one, there was no way i could stay in the premises any longer so what could i do ? i sent details of my situation and gave contact information. If they didnt take this on board its not my fault, i was very clear in multiple letters about the date i was moving out. These were sent recorded and replied to so they definitely read them - i can see how they can legally keep addressing me after my move out date at an incorrect address.

It all stems from this, i couldn't do anything, they wouldn't accept my money, they wouldn't accept my information (although they never mentioned anything about disregarding it at all)

i gave them a means of contact and i don't understand why they just ignored his notification, so when they did not contact me at all it appeared they were no longer interested in the issue.

Its just frustrating they can ignore me then use incorrect information which results in me getting defaulted , and an unnecessary means of paying back the money-

Why would they not use the contact details they were given by the customer if they wanted to pursue the matter , cant see how that is anything other than backwards.

Im still undecided whether to defend or just accept, people have explained to me how im the bad guy(i made a hell of a lot more effort then some people would, why would i write multiple times and provide contact info , and state clearly i wanted to honor the debt after i moved out , if i wanted to avoid the debt ?) here but no one has mentioned my query about the affect of just ignoring it , if you already have a useless credit file

a quote form one of my letters

"I will actually be vacating the premises of ***** on 26/09/08, so please can you update your records to this effect, any further letters sent to this address will not be received, I will not accept responsibility if you fail to read this or ignore it when I have clearly informed you of this. "

"This letter has been sent by signed for post so proof of delivery will be taken as proof that this information has been taken into account"

couldn't be much clearer, so i don't see why its my responsibility if through there incompetency they didn't action this customer request - but hey i guess they just walk over people everyday so why am i different , i least i have the will to try and stop them taking the p**s out of me - im a human being not a piece of paper don't see why i should be treated like my words mean nothing.

Maybe it is , and i would have if they had contacted me as requested - it would have been paid ages ago. I have morals though i'm not a piece of crap with a bank account; they should show some respect, i have a bit more about me than that and will not let people or companies get away with unjust behavior especially when it is to the detriment of my personal circumstances.

they ignored me and went the back way to getting my money, involving hounding debt collectors and messing up my credit file - as such im not very well inclined to just give them their money without pointing out how much they have messed up what could have been a very simple process - but doesn't matter to them as im the only one that suffered regardless of the effort i made.

As far as im concerned i left the affairs awaiting their contact (the company i had debt to) they still haven't contacted me so its as simple as that. all they have done by involving these over parties is waste their time and cause myself unnecessary crap to deal with.

A mobile phone number and an e-mail (hotmail?, gmail?) address are throw-away items, they are no substitute for a brick-and-mortar address. It is you, who wilfully withheld the current address; you had to prove your address for the bank account which you opened at the same time.

How can the bank legally deal with someone who is hiding in cyberspace?

If you are going to reply at least read the thread, i had no address , what bank account did i open ? - there is nothing wrong with email or telephone at all companies have used them for years.

Perhaps the bank could try contacting the customer on the details given ?, the bank give me a phone number and it is acceptable for me to call them , and i have cummincated with compnaies by email for years , its much quicker than a letter and more direct than a phone cool - your comments convey nothing but bitter spite, this is meant to be an advice forum not a troll excersie yard

obviously i just didn't want to give them the address of the lovely house id moved to , you're spot on bengal

its like troll central here these days

    That bank account.

I had a bank account with overdraft, and was moving to a new bank and having to move out of my house so wanted to pay this off.

There is nothing wrong with using telephone and e-mail in addition to a proper address. All banks will ask (and are obliged to ask) for proof (utility bills, bank statements) of your actual address. Many banks will not accept a mobile phone number without a land line, as a land line terminates in a physical address, a mobile number can be abandoned in an instant.

If you were so determined to pay your debt, why did you not walk into one of the branches and not leave it until they had accepted your repayment offer? Or picked up the phone to them? I am sorry but your assertion that you really, really wanted to pay your debt is not convincing.

The bank account was opened at a later date, in my letter i told them i would be able to updatethem with my new address details in the future providing they kept communications open, they didnt.

You guys seem to be living in the past a bit, who has a landline these days ? And walking into a bank and talking to a clerk will not enable you deal with issues like this , its all dealt with at head offices the branches are pretty useless when it comes to anything out of the norm.

i appreciate the time taken to coment on this regardless if i agree , it seems like that is all the advice im going to get here - i will take into consideration of my next step with this issue.

    thanks

Did you really believe that you were in the position to dictate conditions?
You seem to be under impression that if you owe them they would do everything you want to get their money back.

Well they can either send letters to an address they have been informed i am no longer at, or use the direct contact details i provided to continue the discussion - it would seem a pretty stupid to choose the former.

They caused an issue here we were in discussions and they failed to reply , unless they purposely ignored information and sent to address where they knew i would not see it. that is where problem is

you can turn it round and claim me to be the bad guy, but that point is clear as rain - all they had to do is reply to me to continue discussion, as far as i'm concerned i'm still waiting for it.
