Belmont Parking Services

There was a Parking Notice from BPS (Belmont Parking Services) on the windscreen, but the keeper has had nothing in the post. Is it better to wait or appeal? It says Contravention: No Permit Displayed and then goes on to say £100 or £60 if paid within 14 days. It was issued about 10 days ago.

    First things first, are you the registered keeper? If not, who is? And was this in England/Wales?

    The Notice to Keeper will only arrive between 29 and 56 days after the alleged event - Take a look at this thread and also check out post #12 on it for a flowchart of the overall process

    p.s. if you're worried about losing out on the 14 day reduced amount don't be -
    by following the advice in the thread above wait for the NtK - appeal to the parking company as registered keeper
    then when that gets rejected you can submit a POPLA appeal
    You stand a better than 99% chance of getting this cancelled and paying ZILCH

    Ok, the advice here is to wait for a notice through the post (29-56 days after the windscreen ticket). Then appeal this, as the registered keeper, using the templates in the Newbies sticky thread.

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    They say they take appeals within 28 days, but this notice is supposed to come through from day 29 onwards??? :/

    The 28 days is to appeal as the driver. If they get no response then they have to go to the DVLA and get registered keepers details. They then have to send a notice to the registered keeper, and give the registered keeper a right of appeal.

    I think the advice would still to be to wait but will check for you if this is one of the small outfits with whom it's best to appeal early

    But if they're not then if they want to obtain keeper details I believe they are required to give a right of appeal as they are members of the BPA and need to comply with the Code of Practise which states
    22.1 Under the Code you must have procedures for dealing
    fairly, efficiently and promptly with complaints, challenges
    or appeals. The procedures must give drivers and keepers
    the chance to challenge a parking charge notice. If a
    motorist pays a Parking Charge Notice and then appeals,
    you do not have to accept the appeal unless you opt to
    do so

    If they don't get keeper details then the only person they can pursue is the driver and they don't know who that is. And you are under no obligation to tell them.

    Is it possible for you to post a picture of the windscreen ticket for us to see - make sure any personal/identifying details are blanked out though.

    If unable to post a picture - what does it says happens after 28 days?

    I think as long as this is the person's own car, I would wait for the Notice to Keeper even though it might well be a letter from PCS or TNC (debt collector). They have to allow a keeper to appeal, and that would then be a case of submitting the first appeal template letter in the NEWBIES thread. The alternative is to send the template letter now if the friends would prefer to act sooner rather than later (but don't change the wording).
