ESA CLAIM CLOSED due to prison???

Hi, I have recently been released from prison. I was there for 8weeks.
I have now got out to claim ESA once again as my depression is worse. I was on ESA for 4years prior to this. I had passed 3 medicals the most recent medical was in september via the ESA50 form were ATOS didnt require to see me, they declared me unfit for work for 18 months.
Now the problem i have is that they say i may need to do the ATOS medical AGAIN now this is more pressure on me after all that i have gone under upon recently.
What can i do can i appeal a decision makers decision etc?

Well you didnt need ESA in prison, so it seems natural for the claim to be closed.
Whilst I feel immensely sorry that you have such pressure on you due to committing a crime, I don't think that the DWP will.
Perhaps look for work in the area you committed the crime in, as you are clearly capable of that!0 -

Well you were sent to prison, not community service, not a fine, a custodial sentence. And I assume its the drugs you posted about before... charming.
You did not need ESA in prison, as you were provided for. The fact you were able to commit such crimes will probably make them want to reconsider your claim, and rightly so.0 -
When did your ESA claim stop?
If it has been within 12 weeks of your claiming again then you may be able to claim without going through the assessment phase under the 12 week rules.
If the claim ended more than 12 weeks ago then you will need to make a fresh claim.

It seems that he was growing cannabis in the rented property under duress. Instead of going to the police he decided that he would go along with the enterprise. Presumably this duress meant that someone was standing next to him all of the time with a knife at his neck!
No doubt he was in it for a 'cut' of the potential profits.
Maybe he would succeed quite well as a door to door Betterware salesman and earn a living the honest way?0 -

I heard it's a really hard plant to grow so the OP has actual hands on horticulture experience. The OP might also have building experience because I saw an episode of Holmes on Homes and in order to grow it you have to redo the entire duct work and plumbing system in the house because it has to maintain a certain humidity.0 -

Maybe he should keep an eye open for engineering jobs that will be coming up when they build the new HS2 line. They will always be on the look out for those with relevant experience such as ducting, humidity and air conditioning projects when driving through a hill or a mountain with a boring machine.0
