As stated previously, the DPA does not specify any maximum period for the retention of information. The 5th Data Protection Principle merely states that "Personal data processed for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes."
For example the current version of the Barclays 'Terms and conditions for Personal customers' states that they collect information in order to "protect ourselves against harm to our rights and property interests". (I'd imagine that was a fairly standard purpose included in credit agreements.) So long as Barclays are using the information for the stated purpose, I'm struggling to see where the grounds for any 'legal action' would lie.
But that's just my opinion, you understand.0 -
Just accept the decision and move on - that's what I've done.
From experience, the ones who are not forgiving (i.e. they wrote back and said "according to our records etc etc") are:
- American Express
- Barclaycard
The ones who have forgiven me (because they gave me another chance - or forgot!) are:
- Capital One
- Lloyds
- MBNA
And all of those who did forgive have given me very good limits.Never argue with an idiot. Especially not this idiot because I'm always right anyway.0
