Excel parking notice, incorrect reg entered at ANPR site.

    No POPLA excludes mitigation and that believe it or not incudes having paid so don't send the ticket.

    I think you may have used an appeal that relates specifically to Parking Eye so will need amending to relate better to Excel

    Also needs tidying up re different fonts and font sizes.
    Include a numbered list of the points at the start and number the headings in the body of the appeal also.

    Was this at the Peel Centre by any chance - even if the answer is no might be worth taking a look at this POPLA written specifically for Excel (at the Peel centre) see the version in post #20

    No It was not the peel centre, this carpark has no retail attached to it. Would the example you have directed me to win an POPLA appeal as it seems less evasive than the template I used.

    What do you mean by it seems less evasive?

    The template I gave you the link to is the template example for Excel from the How to Win at POPLA link in post #3 of the NEWBIES thread.

    Sorry, I`m going to use the template you have linked above. I don`t think there is a lot to change so I may well just send it to them.

    No one template is ever a 100% match so you will need to check it to make sure it all relevant to you - for example I think in that template there is mention of Nandos as the OP it was drafted for had intended to park in area for that restaurant. So it may well be a better match but give it a careful check.

    20th april so I have a few days yet. My main reason for choosing the first template was the strong amount of case law there, But if you think the new one you have pointed me to will have a better chance I will go for that one.

    You have to be careful with Case Law, because if you don't understand it, or worse, haven't even read the cases cited, then it can make appeals look a bit silly if they are quoted out of context.

    Best sticking to tried and tested (and winning) simple appeal points about which you are confident in their context and meaning.

    The main ones - no GPEOL, no authority to enter contracts with motorists, unenforceable penalty, signage, ANPR accuracy - are well documented in templates and are pretty invincible at POPLA.

    Hi Noppix,

    I linked it for you to take a look at as an Excel specific example - you are the one that needs to decide what to include in your popla draft - it is your appeal.
    If you are happier with the other draft then stick with that for getting feedback on but this isn't a one size fits all stage of the process and you will need to carefully check whether what's there is suitable for your particular PPC, the type of alleged event and the type of place.

    Would it be advisable to use this line in the POPLA appeal if it was not in my PPC appeal: Excel have no proprietary interest in the land concerned and have not responded to a request for a copy of the contract with the landowner in which authority to pursue outstanding parking charges is granted
