    1) Anyway, back to this UKPC charge. I guess my only way out now is hibernate? Until they give up?

Coupon-mad mentioned contacting the landlord. Is it too late to contact now? What difference can it make? I'm assuming I need to contact the service company as it's a friend flat so he is a landlord.

    2) I saw the Youtube video on Watchdog which talks about UKPC and one of the man said to ignore and just make a paper plane. Is this the same advice since it's a few years ago now?

    !
its NEVER TOO LATE to contact the actual landowner or their managing agents, its also the best way of getting this cancelled for good too ! (notice I didnt say landlord, although the landlord should know who the managing agent is so get them on the case too)

so should always be a method you employ

    2) old advice as its pre POFA 2012 , so now only valid for scotland and northern ireland

But seeing as this is UKPC, ignore is probably still a valid option. Just be prepared for a series of threatograms (which you'll file away for records, but not respond to).

Old Rupert will be miffed, but nevermind.
if you can badger the car park owner as mentioned above.

It's AEJ Management. Got an email from them declining my appeal. Are they part of BPA and can I use POPLA (not that I have faith in them since they just decline my UKPC case)?
I checked on BPA site showing they are but have other areas not ticked.

I'm asking my friend to try and contact the service agent since he is the landlord and I was there to help him move furniture quickly.

Do you think UKPC will still give discount even I lost the POPLA case? Or they will demand £100, which I will not pay ever!

    Thanks

they are listed so yes if they have rejected your appeal they should have given you a popla code

as already explained, if you had come here before writing your ukpc popla appeal you would have been pointed at winning words and won the case , so not poplas fault although they are on the side of the BPA unless you point them right at the legal arguments

in this case YOU WILL use popla appeals from here and win at popla , once you get a code

ukpc will give it to debt collectors, and the newbies thread has a post dealing with just that topic, which is IGNORE debt collectors , only deal with an LBC or court papers

Thanks for the quick response Redx.

If only I knew earlier. Oh well... I guess I learnt something. Hence, the 2nd ticket from AEJ Management. I am not taking any risk again so need you guys expertise on it.
AEJ reject on email and said I should get a letter with the code. Although I have not seen anything yet hence wondering if they were on the list.

If I do get the POPLA code, do I just use a standard winning template from here? As I have already appealed to AEJ saying their sign was not sufficient and poor makings. Do I still mention these on the POPLA case? Surely operator will still keep hold of my first initial appeal letter. Does this make any difference to my outcome case?

What is the chance of getting LBC or court letter? Is it definitely get one or rarely?

Thanks for all the information. Hope this helps other people too!

all the answers are in the newbies thread and you are getting ahead of yourself here

there is no "standard template" for a popla appeal , each one is different although there is a guys-dad basic one that has the essence of them (ideally find one similar to your case and plagiarise it)

as for the LBC etc, you have to go to court , AND LOSE , AND NOT PAY within the time stipulated by the court, in order to get a CCJ

as for what chance ? - depends on the PPC , some do , some dont, some rarely, nobody here can predict that future, some who didnt now do , its a lottery , but this was all explained to you in earlier replies as well , so please read replies when good people have answered you

going back to that popla code, clearly they have broken the BPA rules as it should be in the rejection letter, so reply and say so and threaten to complain to the BPA about their breach of the BPA CoP as detailed in recent BPA newsletters that gave them specific guidance on issuing popla codes

In the NEWBIES thread there is a hyperlink 'How to win at POPLA' and that takes you to examples to see the winning words about 'no GPEOL' etc. But they are not meant to be copied verbatim as templates, just to illustrate the winning words. You can't have a one-size-fits-all POPLA template really, not quite.

Don't pay either of the tickets of course, losing at POPLA was a mistake but not binding on the appellant.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Hi,

Follow guidance on this forum to the Tee- it is a little time consuming if you are not used to forums etc. but the result is oh sooooo bitter sweet.

Firstly, you fight back with "Not Genuine Pre-estimate of Loss (NGPL)", No more about it- Not a Genuine Pre-estimate of Loss! That is That!

Only after putting Not Genuine Pre-estimate of Loss do you put in as much as you can that relates to your situation. All can be found on the 'Sticky' on here and the 'Newbies section' both on this forum. Be honest and put what ever you feel is right.

May I politely suggest that you do not EVER, not EVER use mitigating circumstances such as** my ticket dropped from the display, blew away, wrong reg number, or in my case (17 mins overstay through...)*** because no one is interested in the why, it will do nothing only go against you in the appeal and you will lose.

No one is interested in what happened before or after. Again, in the most politest way, and if you follow advice the forum will guide you through it, as they genuinely do care. I genuinely feel that a few experts on here are a bit fed-up of screaming "'No mitigating circumstances- especially at me !:), no excuses will be listened too by anyone" as much as the experts on here actually feel for you and want you to win!!!!! Your win is the forum's win!

You have to go with the advice on here. No doubts about it Genuine Pre-estimate of loss- MUST- be on the top of your list to appeal against. Then anything on this forum that supports your honest situation, be honest but throw the book at POPLA and Parking Control Company. Give them some real time consuming work to do!

How am I so sure- *********YIPEE I WON today!!*******

I won my appeal today, through listening to the forum. I had many questions like surely I can't just put NGPL, What does that even mean? What does mitigating circumstances actually mean? Why, wont any one listen to my honesty? Who is Sticky? Lol! etc.

    From my letter today,

"... The Appellant has made a number of submissions, however, I will only elaborate on the one submission that I am allowing this appeal on, namely that the parking charge amount is not a genuine pre-estimate of loss.

"As the Appellant has raised the issue of the charge not being a pre-estimate of loss, the onus is on the Operator to prove that it is. The Operator has produced a list of a number of heads ( with out brains I don't doubt) that has to be paid for in relation to managing the car park, however they have not given a breakdown of costs to indicate exactly how much each thing costs and I am therefore unable to ascertain whether the parking charge amount is a genuine pre-estimate of loss."

Thank You to Assessor Nozir X

Scandalous! How can someone get away with not declaring expenses, earnings.

Do not name anyone (Like I did) Yourself, partner or child, it's not your place to do UKPC's leg work they have employees to do it, and if you make it easier for them then they will carry on robbing the vulnerable.

    Good Luck!

Thank you again to the forum X

  • Again, thanks for everyone's input for information.

Regards to UKPC, I might be getting somewhere with it after contacting the landlord.

I'm thinking of doing the same thing with AEJ Management. Does anyone know who is the landlord to get in touch with? The ticket was issued in Galleons reach in East London. Its a retail park with lots of various shops. Would landlord be any of the shops that I visited and bought an item or another company name?

    Thanks!
