UKPC parking ticket- Wrong "Make" ticket but POPLA Rejected my case! Please help!

Hi Guys,

I'm new to this forum. Hopefully someone can advise me.

To cut the story short, I have been issued a parking ticket by UKPC. The ticket issued has everything correct apart from the Make of the car.
I have appeal with the operator saying the ticket is invalid as I do not own this car. They have reject to accept my appeal a few times and eventually gave me a POPLA verification code. I then submitted the case with POPLA hoping they will stand by my case. POPLA has declined my appeal which I do not understand.

I thought the ticket issued is invalid as it does not match my V5 log book? Is the ticket even valid in court?

I'm now lost as to what I should do next or have I lost the case? Any advice or help will be appreciated.

Thanks!

  • UKPC dont do court, if you knew their legal advisor they wouldn't do a very good job

So dont do anything unless you get real court papers, if you do i will happily sort a defence for you with this lot

Correction: the ticket has everything correct except it is a FAKE ticket and legally worthless, something you failed to point out to PoPLA.

PoPLA is in the pocket of the parking companies and will ignore the glaring legal issues unless you rub their noses in it.

You have made some serious errors of judgement here you seem to think:

    The ticket is official...wrong
    UKPC attendant can read...wrong
    UKPC are reasonable...wrong
    UKPC abide by normal logic...wrong
    UKPC would listen to you...wrong
UKPC will take you to court....wrong
    POPLA is impartial....wrong
The make of the car makes any difference to their made up rules...wrong

You will now get about seven letters from UKPC/Debt Recovery Plus/Zenith or whoever else they dream up to threaten you.
They are all idiots just ramping up their fake charges.

What a shame to hear of someone writing to POPLA about 'what happened' when POPLA doesn't consider mitigating circumstances. If you'd come here earlier you'd have won at POPLA, we have a few words you could have used. Next time with any private parking ticket, do check our sticky threads first.

But the good news is UKPC don't do court and if they break that habit of a lifetime with you then in post #2 KIFL has offered to sort out a robust defence that would kick this lot into touch.

You will now run the gamut of tedious debt collector letters pretending you must pay. You MUST NOT, POPLA is not binding on you.

    Thanks for the feedback guys!

Are we saying that the only option I have now is ignore all debt collector letters and not to pay them?

I've read some comments saying do not ignore the letter so wondering which one is best?

If I choose to ignore, how long will the letter last? 2-3 years? or forever?

I really don't understand why POPLA did not go with my appeal. :(

Because you didn't write the winning words - small points like you mentioned about the 'car make' was barking up the wrong tree and don't win a POPLA appeal. In the NEWBIES sticky thread, post #5, you will find a hyperlink 'How to win at POPLA' if you want to see how you could have won. We win 100% of POPLA appeals - so, come here next time as you could have killed this with one sentence about no GPEOL (to understand acronyms & learn what you should do in future if you get another fake PCN, see the newbies thread, top of the forum).

And the same sticky thread tells you what your options are at debt collector stage. Complained to the landowner yet? But NOT about the make of the car, please forget that issue!

We say people shouldn't ignore a PCN - you didn't ignore it, you just didn't research a winning POPLA appeal - which isn't the end of the world, just a shame as yes, you will now get the usual debt collector drivel people have been ignoring for years. No biggie. I've had four fake PCNs and loads of people have had more, look at tospig's collectin of debt collector letters re a few UKPC fake PCNs he collected:

You now go into 'ignore mode' but search the forum to read ALL the hundreds of other tales about this letter chain (DRPlus and Zenith letters will arrive for a year I think, yawn...sorry, my bugbear...these letters are nothing but so many threads are started unnecessarily about them every day). You'll be fine as long as you read those same boring threads to see what letters to expect! Just don't expect me to read them or get interested about every letter that arrives...I am now 'on strike' as far as debt collector threads are concerned as they are soooo boring and soooo unneeded!

Yes, there is nothing else you can do at this stage, other than pay which nobody here would recommend. UKPC have never taken anyone to court so the chances of anything further coming of it are virtually zero.
I've read some comments saying do not ignore the letter so wondering which one is best?

That applies to the pre-POPLA letters, now that you have blown your chances all you can do is ignore them.
If I choose to ignore, how long will the letter last? 2-3 years? or forever?
They will give up after 6months or so, and may try to send other letters, but ignore everything except. In theory they have 6 years to make a court claim, but don't hold your breath.
I really don't understand why POPLA did not go with my appeal. :(
You are making the mistake of thinking that POPLA apply common sense, they don't. Mitigating circumstances like you tried to use, fail every time, whereas challenging their legal right to issue these tickets works every time.

    Perverse, isn't it?

The reason I hate UKPC so much is that I had a ticket from them two years ago (when the advice was to ignore all PPC's).

All for parking over the line slightly in a 1/4 full free car park.

They sent me a load of threatening and nasty letters along with Debt Recovery plus, and Zenith, all their correspondence is dressed up to look official and frightening.
The initial ticket impersonates a legitimate one too.

I was bombarded with this rubbish for months they eventually start offering reductions in the charge when they get desperate then they gave up.

Stand firm and don't let the scum intimidate you.

Thanks for your all your reply guys!

I know some of you response to the same question or similar daily, but thanks for your input.
I've read up more about the parking ticket on this forum. If only I came here earlier then I will use the winning template. I just thought it's obvious the ticket was invalid. Didn't realise POPLA will not look at this way.

I do have another parking ticket with PaymyPCN which I will read more and come back. Briefly sure a thread which mentioned they are not part of BPA so can't use POPLA?

Anyway, back to this UKPC charge. I guess my only way out now is hibernate? Until they give up?

Coupon-mad mentioned contacting the landlord. Is it too late to contact now? What difference can it make? I'm assuming I need to contact the service company as it's a friend flat so he is a landlord.

I saw the Youtube video on Watchdog which talks about UKPC and one of the man said to ignore and just make a paper plane. Is this the same advice since it's a few years ago now?

Again, thanks for everyone's input on this. I'm sure it will help other cases as well!

PayMyPCN didn't issue you a ticket, that's just a payment agency some of the companies use. What company issued the ticket in the first place?
