PE Parking Charge notice lost, get a copy?

Hi,
I can't find the first Parking Charge notice sent to me by ParkingEye :wall:
I do have the soft appeal rejection letter, with PE and POPLA reference numbers.
I need to appeal to POPLA before April 23rd.
Can I get a copy of the notice from PE, or I just assume that the letter is "standard", so I go on with the appeal reusing 2014 POPLA won cases against PE?
Thanks.

PE send out standard rejection letters (in fact some of us doubt whether PE reads appeal letters at all!).
More importantly, do not delay as the POPLA code is strictly time limited.
See coupon-mad's 'newbies' thread on page one of this forum, for what to do next, and if you are still unsure, post your POPLA appeal here so one of the regulars can check it over before you send it.I'm a retired employment solicitor. Thanks for the quick response, zzzLazyDaisy; but what I have lost is not the rejection letter, but the original Parking Charge notice letter.
I guess that is also estandard (in my case, do not purchase and show any parking ticket). But as the Appeal is based in details about that letter, I am not that happy to go on without it...0 -

You could ask for a copy of the NtK but it's highly unlikely they'll respond let alone provide you with a copy so I would just get on with drafting your POPLA appeal and not worry about it.
If your worried about being unable to check whether the NtK was compliant - they are usually a standard format and pretty compliant with POFA 2012 section 9.
The main thing re the NtK would be whether it was received within 15 days of the alleged event(assuming there was no windscreen ticket) and you may be able to recall if that was so.
In any case, they will also have to produce a copy in their evidence pack response to your POPLA appeal so you'd have chance to check it then and could send in any extra points to POPLA before the appeal deadline. That's if they respond - which at the moment they're not bothering to at all - so you win by default as they're a no show.0 -

The strongest POPLA appeal points are about no genuine pre estimate of loss, no legal standing or authority and non compliant signage and none of those need the details that were on the NtK.0 -
You're unlikely to get a copy from PE, so move on without it; don't waste time or effort chasing shadows. The PE NtKs are standard templates and no one has found any glaring PoFA related omissions - so not a major appeal opportunity.
Not a GPEOL, signage and locus standi are the key points to pack this away. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Yes, I understood that.
The PCN is also a standard document.
Either way, the fact remains that you have enough information to make an appeal to POPLA and you should do that sooner rather than later as the POPLA code is strictly time limited.
You don't need to know what it says in the PCN, you simply need to address the legal points necessary to win at POPLA.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
Is this thread related to your PCN for fistral beach?

Pe have to send in the ntk as part of their evidence pack so move on and do not miss the popla deadline because of this. Once you get their evidence pack you can submit further representations to popla. However pe are not even bothering to send in evidence packs these days and so lose by default.
DO NOT MISS THE POPLA DEADLINE
to be honest, you will win if you submit this appeal.
The charge is not a genuine pre estimate of loss, as explained by Henry Greenslade, Chief Assessor in the 17 page document published on the POPLA web site.Dedicated to driving up standards in parking0 -
As long as you have the PE reference number(s), that is all you need from the PCN/NtK.
You have absolutely no need to refer to anything in the PCN/NtK. The details are irrelevant.
You use one of the standard template appeals majoring on GPEOL. PE will recognise this as a forum aided appeal and, so far, they can't beat GPEOL so they fold.
Don't try to be creative, just go with the winning strategy.0
