Have you collected them from the neighboughs yet? And how?
Just re-read your post and I think you'd be entitled to get somebody else to colect from the address 1 mile away and deliver them to you. Then deduct this fee from the balance. Probably not withhold the whole sum. If there is a deficit then potentially leaving them liable.
Give them a last opportunity maybe, set a tight deadline, say a few days telling them time is of the essence.
At least that way if they do sue you can demonstrate a couple of attempts of allowing them to resolve it0 -

So you agree that you sent an alternative and unsuitable vehicle for the delivery, which meant you were unable to complete the delivery correctly?
I can't see how the customer can be blamed for you failing to fulfil the contract, when she advised you of the narrow drive in advance.0 -
The facts are rather elusive to some people, it seems. Far easier to construct a scenario that puts the other person in the wrong, than to admit fault and put things right.
1. My initial email stated that the units MAY have to be left at the bottom of the drive. This would only be the case if the wrong vehicle was used. I was assured that an appropriate vehicle would be used.
2. I did not CHOOSE to re-direct to an alternative address, I was forced by circumstances, i.e. the wrong vehicle and the late delivery (9.15pm) to re-direct.
3. I am within my rights to withhold payment until the delivery has been completed. I contacted the company to look for a solution but received only intimidation and threats in return.
4. There was no communication from the delivery company about vehicle issues or eta. I received one phone call at 6.45pm to say the delivery would be late, but no other information.0 -
Uneducated on here? You mean you then with those spelling mistakes and a complete lack of punctuation?
You forgot to mention that we only have the mds logistics' word that they are in fact the owner of the company concerned. They could just as easily be the delivery driver, office cleaner or the OP's next door neighbour, hence the reason that company representatives have to get permission from the MSE mods before posting on behalf of a company, something that hasn't occurred in this instance.
If mds logistics can't even be bothered to read up on the requirements for posting on this forum, why should anyone expect them to understand their legal or moral obligations towards their customers?0 -
I received a highly threatening message from one of MDS's employees on Facebook and, as a result, the owner has apologised and told me to keep the balance as compensation.
A couple of smaller issues to sort out and then we will draw a line under all this.0 -

Oh yes. I forgot to mention in my post that I had reported theirs for breaching the terms of MSE
