It fails as it says you have failed to pay a £35 parking charge, well unless it costs that to park there, how can you have failed to pay? Also they indicate that it goes to debt collector stage after 28 days. So no notice to keeper, maybe? Or no chance for the registered keeper to appeal this and go to popla?
Did you pay to park? If so there is no loss, and they cannot punish you for this. Ask them for their parking policy document, if they are in the aos I would interested to know what's in that. Unless this person hasn't paid to park then there is no loss! The problem, as I see it, is that it was a staff only car park. If that is correct, then it was not open to the public and in parking there OP was trespassing. If that is the case, there was no contract between OP and the landowner to park there, and no alleged breach of contract. GPEOL only applies in BofC claims. In trespass the lamdowner is entitled to be reimbursed for any costs incurred as a result of the trespass. £35 is a relatively small amount to justify when taking into account the admin costs and the costs of considering and replying to the appeal. I am not saying 'don't appeal to POPLA' but I am saying 'get the grounds of appeal right, if you do proceed to POPLA'
Having said that, the POPLA assessors don't always understand the finer points between trespass and contract law anyway, so there is always a prospect of success, even with a GPEOL argument - but I'd argue against damages for trespass in the alternative to be on the safe side.
Whatever - at least OP now knows he does have the verification code now and can go ahead and prepare an appeal to POPLA.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
They haven't alleged trespass though - they say 'your vehicle was parked in breach of the Terms and Conditions of Parking'. Might be useful to see the signage wording.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
