Having won our case on a completely different issue (having your photo taken going into and out of a car park doesn't actually constitute parking), I'm interested in all the stuff that seems to be buzzing round the County Courts at the moment. On the face of it (or, as my cheap book on legal process say's, prima facia), it would seem that the Judiciary seem to absolutely detest what parking companies are bringing to their Courtrooms, and agree on one thing-these charges aren't legal. They seem to be bending over backwards to establish that. My concern is, they all seem to be bending different ways.
The Cambridge case seemed to get "knobbled." What is the precedent that is trying to be set ?Illegitimi non carborundum:)0 -
That's the trouble with the County Court. With no precedent from the higher courts it's open to each individual judge to decide matters however he sees fit.
However, since news of the Cambridge case has reached Sheffield one can assume it has spread nationwide and, whilst the Cambridge case (when it is eventually heard) cannot set a precedent in any formal or legal sense, presumably it can establish some principles which District Judges nationwide can take as guidance.Je suis Charlie.0 -

IIRC the deferred date for the Cambridge case is tomorrow. I was tempted to go along for some popcorn time but then it occurred that court space is limited and I'd only be clogging up a seat to the exclusion of a savvier member of the public (bargepole, PP, etc).0 -
