Been a long time since I needed to post on here but pop in from time to time to see how things are going especially since the POFA.
OK so daft questions time (especially since late to bed last night:(),
I have read the bit in POFA but from reading posts on here I was under the impression that only the driver was liable but am I correct in saying that under POFA that the keeper could be liable.
What I have is a PCN from Parking Eye for one of our drivers parking in a retail park, they have obviously got our details from the leasing company but now state that parking charges can be recovered from us as we are the hirer / lessee.
Is that correct or should I just reply giving the drivers details.
I have no intention of paying this then charging the driver.

Yes you are correct that under POFA the keeper can be liable.
I'm assuming the PCN you refer to was sent directly to your company by P E and not forwarded to you from the leasing company.
You can appeal this invoice as Keeper on the day without having to name the driver.
With help from the information on the forum you stand a greater than 99% chance of getting this cancelled.

Collies your first link isn't working for me. The PCN had been sent to our lease provider who informed PE of our Company details and then it has been sent to us.
Are you suggesting I make the appeal on behalf of the driver because although I have managed to get all our lease providers not to pay the initial charge and to advise them of our details, unfortunately I have been informed by those above that I should not get involved with individual appeals.
I am therefore likely to follow the advice from Bods search suggestion and let the driver make any appeals.

Did the lease company provide you with a copy of what they sent to Parking Eye? Did they say they were naming the Driver or the Keeper of the vehicle? Regardless, it seems the lease company have followed BVRLA guidance and named the keeper/driver, so unless the contract T&Cs allow them to charge you an admin fee for doing so (T&Cs usually only refer to fines and penalties - these PCNs are invoices so not included) then there should be no charges to you from the lease company.
Either way, you could easily just appeal via the standard appeal in the NEWBIES sticky thread (that's the broken link in CC's post). Simply change registered keeper to usual keeper.0 -

This could be appealed as either keeper on the day or by providing them with the details of the driver - the driver can appeal directly.
If you have been advised by the higher ups not get involved then you can discharge any liability by naming the driver and letting them appeal
But please let the driver know about the forum and the NEWBIES thread info, advice and template appeal letter and they should be able to get this cancelled.0 -
