In the end I have chosen a deal from mobiles.co.uk where is a refurb phone but that just means it was returned in the first 7 days, it still comes with a year warranty with carphone warehouse and the normal 2 year samsung warranty so lots of ways to get it fixed if there are issues.

It has £165 cash back phased over the life of the contract as well for £33 a month with unlimited texts, calls and 5g of data. I chose that one for the best data package in the end, as there was another deal a couple of quid cheaper for 1g of data but I thought once 4g gets rolled out more I am more likely to use more data anyway.

So after cash back it works out to £26.12 compared to £38 a month for the same deal with o2 direct, but o2 also don't have any referb phones in stock. So even if the cash back doesn't pay out it is still 5 quid cheaper a month than o2 direct even if they had stock.

I also ordered through quidco but as this deal includes cash back that won't end up tracking fully but they have other deals with freebies where you could then keep the quidco cashback.
