Elite PCN first appeal - is this okay/sufficient?

    Ah, I see. Also, do I need to change my letter of appeal for the 2nd stage or can I just send the same one again?

    The second stage is to appeal to POPLA. The letter is different. But again, there are templates in the Newbie sticky forum (click on the 'How to win at POPLA' link on the third post). The letter is more detailed and contains more detailed legal arguments based around the same basic points contained in the first letter.
  • UPDATE: I sent my first stage appeal on 1.4.14 by post (I got a certificate of postage); I also sent it by email. I received no reply or acknowledgement at all from Elite Management (Midlands) Ltd.

    Today I received a letter from Roxburghe (dated 8.4.14) stating, “Our client had advised that they have not received payment or any valid dispute and therefore it is now too late to pay the discounted amount or challenge this notice."

    After serving the Notice to Keeper, the BPA Code of Practice states that a notification letter to the keeper should be sent saying that the keeper is now liable to pay the charge but, “You must wait until at least 28 days after you sent the Notice to Keeper before sending send a notification letter.” Firstly, Elite's original communication was dated 14.3.14 (though postmarked later) and the Roxburghe letter is dated 8.4.14, so they have clearly not waited 28 days for a response. Secondly, they did receive a response and the PCN was challenged. They did not reply, either accepting or rejecting the challenge and therefore did not provide a POPLA code.

    What is my next step? Should I respond to Elite or Roxburghe or someone else?

    Also, the BPA Code of Practice states that if no challenge or appeal is received they may send a final reminder but they have to wait until at least 14 days after sending the notification letter. They then have to wait another 14 days before taking any further action such as debt recovery against the keeper. I thought Roxburghe were debt recovery agents so is their letter the notification letter or a debt recovery letter?

  • Sorry. All the details were in the original thread, which is why I didn't realise I had to repeat it.

    Two incidents: 19.12.13 and 22.1.14
    Tickets on car - ignored.
    NTK both dated 14.3.14; one received 19.3.14 and the other 20.3.14.
    Two separate Roxburghe letters, both dated 8.4.14, both received today 11.4.14.

    Do they mention keeper liability and pofa 2012 on anything they have sent to you? Because the first ticket is way to late for that ?
