Scs urgent advice needed by any legal beagles!!

To cut a VERY long story short... Had 18 months of troubles with SCS and they have finally agreed to collect our sofa and cancel the finance agreement so we can go our separate ways. HOWEVER... we have always continued to pay every month and to date have paid £650, they are only offering to pay us the £124 deposit we first paid 18 months ago. As they have obviously admitted that they are in the wrong, are we entitled to a full refund as we are handing back the sofa? I can't see how they can keep £500 of our money. Many thanks in advance for any advice

You can't expect a full refund after 18 months. But assuming the sofa was within the £800 region i'd expect a refund of around £600 - £50 as an absolute minimum.0

There were a catalogue of errors which is why they agreed to end the finance and collect the sofa. First sofa was faulty, repeatedly failed to fix it, would turn up with wrong parts etc so had agreed to replace that one so we went in and chose a new one. That got delivered, was the wrong sofa. For 3 months kept forgetting to order a replacement, finally did and when they arrived with that one, it was faulty and wouldn't fit together. They took that away, and we still have the wrong one, which they will also be collecting. Don't see why we should be out of pocket. Basically we won't have a sofa and they still get to keep £500 when they haven't actually done anything apart from muck us around for 18 months!!?? Makes no sense0

We had A sofa but not the right one. First sofa broke after 6 months, they took 6 months to "not" fix it and in the end they agreed we could come and get a new one. This was in November 2013, it was delivered in December 2013 but they had ordered the wrong one, they then forgot to ordered the correct one for 3 months despite me calling and chasing it up and when they did finally order it in March this year, they delivered it last week and it was faulty so we obviously told them we didn't want it and it was after all this they finally agreed that the service had been so bad that we could end the agreement.0

Speak to the finance company.
Under Section 75 of the Consumer Credit Act they are equally responsible for performance of the contract.
MSE's article on Section 75 may help.
As well as that, you have been paying money to the finance co so they should be more inclined to refund your money.
Start your negotiations by demanding a full refund of all monies paid to the finance company.0 -
