Council Tax Benefit Underpayment

Hi

I've just received a letter, saying they underpaid my council tax benefit, by £178, so in other words I paid £178 too much last year. The letter says they are going to send a new demand notice for 2014/15 with revised payments, so they are taking it off this year's council tax bill.

I was wondering if anyone knows if I can demand the money back in one lump sum.

    45 minutes on hold to them and counting, which is why I thought I'd ask on here, if anyone has been in a similar situation.
  • good luck they chase you if you owe them but its usually hard to get them to pay the money they owe you

    It will be this time of year - demands and benefit notifications have just gone out to every household.

    Unless you are currently on full CTRS then they will just deduct it from this years bill.

    It's covered under regulation 31(4) of the council tax (administration & enforcement) regs 1992.
    (4) If there has been an overpayment, the amount overpaid for which such other provision as is mentioned in paragraph (1)(c) is not made—

    (a)shall be repaid if the person so requires, or

    (b)in any other case shall (as the billing authority determines) either be repaid or be credited against any subsequent liability of the person to make a payment in respect of any council tax of the authority.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
