False insurance claim against me

I have a car insurance policy with Zenith via The Insurance Factory. I noticed on my renewal documents under claims and convictions there is an accident on 20/11/12 and says I'm at fault of the incident. I noticed the same information on my documents last year at renewal time and called them immediately as neither myself or my vechicle was involved in this incident. After many chase up phone calls to clear my name and with no evidence being submitted by the third party, it was confirmed that the third party had made an error and my vechicle reg had been given in error. I was told a letter would be sent confirming that the incident would be removed from my file and closed. Also I'm sure they claimed that the incident had no effect on my premiums. To my horror this incident is still on file and seemingly held against me. I have concerns that this will have had an effect on my premiums and 9 years no claims bonus. I have written to the complaints dept of Zenith. Is it common practice in car insurance that a false incident stays on your file before proof is submitted by the third party? Is seems bizarre to me.

    Normally, if an insurer receives an allegation against their client for which they havent heard about from their client they will write to them asking for clarification.

    For a variety of reasons the client doesnt always respond. You therefore send them a chaser letter and again you dont always get a response. At a certain point you need to balance the probability of it being a case of mistaken identity/ human error -v- the cost of letting it go to court and the costs escalate.

    If their client ignores 2-4 letters most insurers will start dealing with the claim based on the evidence provided by the third party which in most cases is fairly straight forward.


    Evidently in this case there are certain other issues. The insurer has admitted their error and despite that hasnt resolved it. File a complaint and if needs be escalate to the FOS

    Thanks for the reply. I've written to the insurers complaints dept and if I get no joy I'll escalate to the FOS.
