Hi,
I was hoping for some advice following a parking charge from UKPC. On reading through the POFA 2012 it looks like they have done everything correctly and I don't have a leg to stand on.
It's private parking for residents (flats) and I have a permit. However, there were no spare bays available, so "the driver" parked my car in a gap which residents regularly use when there are no spaces left (it isn't a space but doesn't get in the way either, which is why everyone uses it). Their ticket claims my car was "not parked correctly within the markings of the bay or space". (incidentally, they also got the name of the road wrong... completely wrong!).
I have held out to receive the Notice to Keeper which has arrived (within 56 days). As per forum advice I am going to appeal (as the keeper), however was keen for some advice on the best letter to use. The example letter titled "THE FIRST APPEAL TO THE PPC" (found within the "Newbies! Need help with a private parking ticket?...." thread) sounds good, but claims that the signage was not compliant with the ATA Code of Practice - however UKPC's signage seems good (at least, I've read the BPA code of practice - in particular section 18 on signage - to which UKPC claim to comply, and it seems OK... I don't know, some of the points are arbitrary.. I mean at what point is the signage considered adequately distributed across the car park to ensure drivers can read it?)
I'm not sure what to do. They're charging £100 for this ticket!! It's robbery. I really want to make sure I get it right on every step of this process.
Should I modify the letter, removing point 2? Are we expecting them to reject this letter and then go to POPLA? It seems to be expected that they will reject the letter and issue a POPLA code.

Send the letter as it is. The idea of the letter, and subsequent POPLA appeal is to make the parking company prove their compliance. Don't do their job for them.0

and the idea is to make them prove their case, so doesnt matter what you believe and its not your job to prove their signage is or isnt compliant for them
use the template letter, go to popla if you have to , but dont try to second guess these parking company shysters0 -

UKPC are just worthless scammers that will try every trick they can dream up to relieve you of your money.
Use the advice on here that the regulars have devised and change your mindset a little and winning against this scum will be easy.0 -

I will appeal using the recommended template both via their website and by post.
Would it be worth highlighting that the road name is incorrect on the invoice? I'm not sure it will make any difference...0 -
It may make a difference and could always be an additional point you could add to the letter. But it won't really change the outcome. Most of these PPC's make the rules up as they go along.0
