Parking ticket from PCM

New to this board so hi guys.
I am living in a block of flats with a private car park. There are marked bays so if you lived at number 1 you have a bay marked number 1. The permit you receive has your house number on it ( I didn't know this until I looked earlier when I got my ticket) When I got back from work last night someone was in my bay. So I just parked in the next available one. I get up this morning and there was a ticket on my windscreen. I have read that these are cowboys and are not valid. Any help?
I also read you can't get a parking ticket before 8:30am, I got mine at 8:24. Any truth in this?

All the information you need is in the sticky thread for Newbies at the top of the page.
Do not contact the parking company yet, wait until you get the NTK through the post. By then you will have read up on how to beat this unenforceable fake invoice. Once you have all that, come back here for further help. Meanwhile, tell us where this happened, as the law is different depending on whether this is in England and Wales or Scotland or Northern Ireland. All this is explained in the sticky thread I have already directed you to.I married my cousin. I had to...I don't have a sister.

It was in Hertfordshire in England, I looked in the sticky briefly as i'm at work and trying to be sly
I couldn't find what I was looking for0 -
PCM are easy to beat. Assuming you are the keeper, wait for the NtK, use Coupon-Mad's appeal in the sticky and it is almost certain PCM will cancel the charge.
They appear to be one of the PPCs who don't want a clued-up appeal going to POPLA cos they know they will lose!0 -
This one?
Dear {company name of this member of ''PPC World''},
PCN number xxxxxxx
As the registered keeper, I have received your parking invoice which of course, I decline your invitation to pay. I wish to invoke your appeals process, since all liability to your company is denied on the following basis:
1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
2) Your signage does not comply with your ATA Code of Practice and was not sufficiently prominent to create any contract
3) You are not the landowner and do not have the standing to offer contracts nor to bring a claim for trespass
So you're saying wait 28 days for the NTK to come through, then when it does appeal using the message above?0 -
The NtK must arrive between 29 and 56 days. Once you have received that, yes you send that appeal.0
-
Ok thank you, and if they don't send it within 56 days I assume it's over and if it comes afterwards it won't count?0
-
It won't make it go away, it'll just give you another appeal point. (NTK out of time per POFA, so no keeper liability anyway). Using the appeals process is the sure-fire way of making this all go away.
Check out other threads here about people getting tickets in their own parking spaces. Check your lease/tenancy agreement for anything relating to parking ... PCM may not even have any authority to issue tickets, and may be trespassing on your property by affixing tickets.

Ok cheers, I was just wondering if my appeal would work really as I actually wasn't in my designated car space. Would this affect my appeal? I just read a thread on a similar subject but he was in his own space but the permit had just slipped down0
-
That's why I mentioned about checking other threads and also checking your OWN paperwork.
Ultimately "what happened" is irrelevant - you have received an unenforceable invoice, and the appeals process is a sure-fire way of making it go away.0 -
PCM really don't care where you were parked, what happened, why you did this or that. They want an easy life and just want your ££. If you show them you are going to put up a fight (with a hard appeal) they will almost certainly move on to an easier target.
Even if they do not, you get a POPLA code and win at POPLA.0
