Hi,
So I have received a parking ticket last Thurs from UKPC. I have no intention of paying as I'm aware of this scam. So I had my appeal letter all ready to post to UKPC prior to reading all the info on here. After reading the advice given, I'm changing my letter in preference to the template given in the stickies.
First thing I would like to confirm is that I now actually wait for UKPC to send me a letter of NTK, rather than me post my appeal to them within the 14 days window given? And then I post my letter of appeal in reply to their first correspondence? I'm actually not the registered keeper even though I am the main user of the car, so the letter will be addressed to my husband. So all future correspondence must come from my husband & he will actually be the one appealing rather than me?
Not sure how much info is required in order to help guide me, but the car park is free to park. The markings on the ground were un-clear consisting of both yellow criss-cross lines alongside white lines indicating a parking bay, all overlapping each other. It was in one of the many carparks at the shopping mall where I had gone. This leads me to my next question. The advice on here is to also complain direct to the private landowner, but this is a huge mall. If anyone knows it was Merry Hill shopping centre (West Mids). There is a full address on the parking charge & I'm thinking of using this & addressing it to 'The Manager', & hope it gets to the right person. Any thoughts on this?

Appeal should From the registered keeper

Yes there are advantages if the keeper is the one appealing especially at the POPLA appeal stage

The manager of the mall may not be the landowner/or the landowners managing agents - some people have had success by approaching the retailers who have been able to give them the details of the landowner/managing agents.

I assume the notice you received was stuck to the vehicle? If so then what you are saying is correct. Wait for a notice though the post then appeal as your husband.0

Good luck and just one more thing to try - the retailers shopped at may also be able to get this charge cancelled so it's worth speaking to the shops0

Hi all.
Well I waited for the NTK to arrive & then used the template on here declining to pay. That letter was posted last week. Today I have received a letter from DRC (debt recovery). I was obviously expecting this at some point but I am concerned that I havn't received anything from UKPC passing over my appeal to POPLA yet. Should some correspondence be expected from the PPC soon?
I need to read in more depth what action to take regarding the letter from DRP. I'm guessing either ignore it or respond with details of an appeal, when I have them.

You complain to the BPA Ltd that UKPC have (a) failed to respond to your appeal and given you a POPLA code, and (b) escalated to debt collectors before exhausting the appeals process, both of which are contrary to the Code of Practice. Ask them what sanctions they intent to impose on UKPC. Did you get proof of postage for your appeal (if sent by post). UKPC will probably lie and claim they never received it - a common tactic from these cheats and liars.
Follow up with a complaint to the DVLA that in breaching the BPA Ltd AOS Code of Practice, they have also broken their KADOE contract with the DVLA allowing them access to the DVLA database, and ask them what they are going to do about this breach.0 -
Thanks. You know I didnt get proof of postage, although I could always print off another copy & get it sent ASAP, although that will take me over the 28 days given to reply.
Is it worth just responding back to UKPC asking for a POPLA code as they have failed to respond to my original letter?0 -
complain to the bpa anyway , even without proof of postage
also complain to ukpc and demand cancellation or a popla code, telling them you have reported them for passing it to DR+0 -

Hi again,
Just after some more support/afvice before I send my next letter. Following on from my last post, I wrote back to UKPC again requesting a POPLA code & advising if one wasnt issued I would report them to BPA.
Today I've received a further letter from DRP. Firstly they are telling me to send all communication directly to DRP now as UKPC have passed the 'debt' over to them to deal with. Is this correct or do I still only communicate to UKPC?
Again DRP state that a code has not been issued as I did not respond in time & the account had already been passed onto debt recovery by the time my letter was received by UKPC. This is where I'm so annoyed & angry with myself as I failed to get proof of posting, so have made this very difficult for myself. DRP say if I can provide a postage tracking number it can be investigated, but obviously I can't. Just my word against UKPC regarding the date they would have received it
So before I send my letter to BPA are there any key points I should include? I intend to give the date the original response was given & that its been escalted to debt recovery without allowing me to follow the correct appeals process. I can't help thinking that BPA will also want proof of posting though? Am I going to hit a brick wall with this?
Any advice welcome & thaks in advance.
