I had a bay laid, and it was more trouble than it was worth - it was ignored by all and the council said they are non enforceable, unless on a Main Street, and a courtesy only, despite the signage and post.

Even if not ignored by the fit, it is also freely available for anyone with a blue badge anyway.

    Lin :(

A bay that is plated is legally enforceable whatever public road it is on.

When it comes to the bay painting, I had an interesting conversation with a guy from my LA yesterday.

My road has just been resurfaced so as it stands there is no painted bay, just the plate. I approached the guy yesterday as he was checking the work done. I said I was concerned that without the lines I'd have trouble with people parking in the space. He informed me that with a plate the bay will be enforced, white lines or not.

Keep badgering your council and park as awkwardly as you can to annoy the petty minded idiots that you have to live with.

You were being fobbed off, if there isn't a bay painted on the road then there is nothing to enforce.

Yeah I must admit that is what I thought, as a user of another site that deals with the road traffic act. Mind you my LA is famous for stupid parking enforcement! Anyhow, they said it, it's up to them to act should I have problems. I won't be resting on my laurels that's for sure!

Some very good news and some annoying news.

The bay is now laid, it was done on Tuesday.

When I got home from work however Tuesday night the woman at next door but one, the same woman who appealed against the bay and had thus been preventing the bay being laid was parked in the bay with a Blue badge.

She hadn't put it on the dash correctly as the name was showing along with the picture and it clearly isn't hers or anyone who lives in her house.

If she had a badge all this time you have to ask why she was so against the bay being laid when she could have used it?

Last night she parked across the road.

Hopefully she was just trying to make a point and get a reaction out of me, but should she park there again with the badge I will be reporting her for BB abuse.

  • Phone the council immediately and ask what their procedure is for reporting Blue Badge fraud. Most if not all LA's have an online report system. Do (3) phone / online / and a snail mail in writing. Give them reasons why you suspect a blue badge is being misused, where and when you noticed it and who you think is using it and provide as much detail about the badge as possible, including [if safe to do so] a photograph of the badge face and registration number of the car. If the registered issue number of the badge has been obscured and is not visible, that in itself is a BBB URL="http://www.direct.gov.uk/prod_consum_dg/groups/dg_digitalassets/@dg/@en/@disabled/documents/digitalasset/dg_186198.pdf"]rights and responsibilities in England[/URL offence if the ""The side showing the photograph should not be visible through the windscreen"".

I'd do it now .. .. waiting has already cost you 2 years. The only reason for obscuring the registered number is to deny scrutiny.

I'd do it now but I don't have the details of the badge written down anywhere, so I need her to park there so I can take photo's, get numbers/names etc etc.

If she doesn't park there again then it's happy days all around.

As soon as I read a few posts on this thread I could predict the future, I knew that at least one of the cars used to block the bay being painted would park in it with a BB as soon as it was painted.

I used to live near neighbours like these, we moved. 12 years on we have no problems with our neighbours though I did have to have a word with someone up the street because they parked on the path and I couldnt get my wheelchair past it but they have never done it again so far as I know.

I know you live in a terraced house because you have posted photos, is their no chance of converting the yard to off street parking? Though they are that spiteful they would still block it.

Do you rent or own? To me private parking is essential so I would move for it, even though we did have off road parking for all three of our cars at our old house the neighbours did try to restrict us by as much as they could get away with and it was annoying.

If I remember there are other problems with your home? Your family cant shower regularly wasnt it because of hot water difficulties? So moving might be the answer.

I dont understand people who are jealous of disabled people, my old neighbours videoed me collecting my daughter from the local primary school, they reported me as being able to drag my useless legs 70m.

There was no distance qualification under DLA mobility rules though if you could only walk with crutches so long as you didnt just walk normally between them so they were wasting thier time.

We own the house, but atm moving isn't an option due to financial constraint, and renting is far more expensive than paying the mortgage on this place,.

The showering issue is a little different, there is no shower in the house currently only a bath which due to the inadequacies of the boiler takes forever to fill, but again due to financial constraints there is no way of funding a new boiler, even through the green deal (which is a complete rip off when you get down to the finer details of the loan etc), so whilst we don't have a bath everyday (usually every other day alternating with the kids), we all have top to toe washes morning and night from the basin.

Assuming I get my compensation in the next few months this should then provide the scope for updating the boiler and adding a shower.

However, back on point, she didn't park there last night when I was out and prior to the bay being there if I was parked outside her house and had then nipped out, she would usually move her car to where I was originally parked whilst I was out. I was gone almost an hour last night and she didn't move her car at all. So I am hoping it was just a one off. A final act of defiance to try and get a reaction from me, or maybe someone has informed her that it is an offence to use someone elses blue badge? Who knows.

It must be different in Scotland as the information says ' for use by disabled occupant' and the application form says a dedicated parking space for the person.
