Thanks again.
I have now emailed the co-op and also the court to request 28 days to prepare my defence.
I will take a look at those links too and try and figure out a strong defence. Its not what I need right now as I'm ready to give birth, but hey ho. Needs must and all that!!

Make sure this doesn't stress you out, this is just a poxy company abusing the court system by intimidation, they have no intention of going to court with you. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

On the particulars of claim what do they state the claim represents ?
Contractual charge ? Parking charge ? damages for trespass ?
Do they break this loss down ?Be happy...;)0 -
They are claiming damages arising from breach of contract.
Further on it states that as a result of the defendants conduct a charge of £130 has been incurred. Due to the defendent not accepting the claimants offer as set out on the sinage. - It does not explain what part of the signage I did not comply with though???0 -
It states amount claimed £130
Court fee £35
Solicitors costs £0
Total amount £165
The losses haven't been broken down, but previous invoices were asking for £900 -
Submit your intention to defend, and seek to have it allocated to your local court. This will mean it is in your own turf, and very unlikely they'll pursue it further. Just because your car was there does NOT bean you accepted any 'contract'.0

They will probably back out, they have lost a few recently

Bit of an update.....After emailing the co-op last night I have just received an email (which I believe is a bog standard template going by my research on similar forums) saying "Please be assured that I have made arrangements for this charge to be paid directly to the debt recovery agent who is acting on behalf of the Parking Management company not the Co-operative.....blah blah"
Firstly I am annoyed that the coop would offer to pay off these bullies when I told them that I bought a parking ticket to cover the time I had stayed. But it seems they are not just not interested in the moral details of all of this.
Furthermore I am confused as the claimant (cel) have a contract with the co-op to manage the car park, so who actually benefits from these fines??? I just find it all very strange! It feels like the the co-op are in on the scam until someone speaks up as then they act like they are doing you a favour. Very Bizzare!
I am now going to email a short and sweet defence to the court to cover my back incase i get overlooked by the co-op in the run up, and put these parasites behind me! As for parking at the co-op again. Forget it!! ;p
Thanks for all who have contributed to this thread.0 -
This is a result, there is no victory, just a result.
Just watch deadlines for a CCJ and if you do not get cancellation notices you will have to file a defence that the principle in the contract has cancelled the charge.
You may have to request a statement from them or worst case have someone brought to court.
Lets hope they cancel the claim.Be happy...;)0 -
No don't send a short defence, send in a full defence to the courts, per the parking prankster website. And the reason why they are paying is that the contract with CEL is as much a scam with the coop as the one with you and CEL. The winners are CEL right now.
They are about to lose their contract with the coop IMO and they know that the coop will cough up when a customer contacts the retailer, so they win an amount off either a victim or the coop they hope.
For the reasons why they are paying is because it's cheaper than cancelling have a look at parking v Somerfield on google. If you didn't know Somerfield are now owned by the coopWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
