    Search the forum for 'Dundee Courier' or 'Gallagher' and you will see those Gallagher Retail Park UKPC cases are discussed already. Basically the keeper isn't liable in Scotland so stay in 'keeper mode' throughout and send a strong complaint letter to the CEO of the retailers or the Management if it's a multi retail park. Keep rattling the cages of the retailers, best to get these charges dropped just in case another firm tries to copy UKPC. But don't try an 'appeal' - there is none in Scotland EXCEPT to suggest you could contact ParkingEye if 'the driver' actually has a receipt or proof of purchase of £30 or more. If so then the keeper can send the driver's receipt online to PE and often that will get a cancellation.

    I have introduced a 'cancellation notice' into the NEWBIES sticky's latest version of a PPC first appeal letter (England/Wales only of course, for 'appeals'). But the new Consumer Law applies in Scotland as well so there would be nothing to lose by serving both Highview and PE with a cancellation notice which to my non-lawyer eye, appears to be your right for '12 months and 14 days' after a distance contract which did not include the correct information in 'durable medium'. Have a good read, I did and this is only a recent idea and not tested by the courts yet. I could be barking up the wrong tree - courts may not agree that these contracts are covered but I have done enough digging to think I am on to something. And it matters not to anyone if this doesn't work!

    I can't see a downside to a consumer, in good faith in view of the legislation, serving a cancellation notice (as long as they don't name the driver in doing so!). A model cancellation notice is in the linked legislation. So settle down with a coffee, see if you read the cancellation regs and definition of a distance contract like I do, and be as proactive as you can be in Scotland without actually 'appealing'.

    Just wanted to say a big thank you for all the posts.:T I received a notice complete with photos of my car and a scary letter from High view. I am certainly not a risk taker and I follow the rules but still managed to bring on the wrath of H.V. for staying 15 minutes over in a free car park in Sheffield. I saw that other posts included a video of Anne Robinson who states that only the council or police can fine you which encouraged me. The encouragement didn't last long and the worry set in. This was when I followed the how to links and logged an appeal with POPLA.
    I received an email stating that I had won:beer: and that High view need to cancel the charges:j so please keep on going, persevere and good luck.
