  • Response from Asda:

    Hi _

Thanks for contacting me about your recent experience when in our _ store.

I'm sorry that you've received a parking charge on your recent visit. The car park at our _ store is operated and maintained by Smartparking. The parking charge you have received has been issued directly by them and I’m unable to dispute the charge on your behalf. You can discuss this with Smartparking by calling them on 0845 230 3081.

Each store has its own parking policy, depending on its size and location, which is highlighted at various points around the car park. If you are unsure about parking at any of our stores, one of my colleagues at the Customer Service Desk will be happy to explain their policy in more detail.

I appreciate this is not the response you were looking for, but trust you can understand why I am not able to overturn the charge on this occasion. If I can help with anything else, please call me or one of my colleagues on 0800 952 0101. Thanks again for getting in touch.

    Kind Regards

    Jonjo Wilkinson

One thing they forget to mention is that it's Asda who hired Smart Parking and it's the store who own the car-park.So they can tell Smart to cancel the charge.
What part of "A whop bop-a-lu a whop bam boo" don't you understand?
  • I guess I'll just wait for the NtK and then appeal to smartparking. Thanks for everyone's help thus far!
  • Hi everyone,

My NtK (or notice to owner as the letter says) has arrived via post today stating I have 14 days to make the payment.

Is my next step to appeal to Smart Parking directly, if so what should/shouldn't I say?

    Many thanks!

Here's a copy of a recent one submitted.

In reference to the speculative invoice TC02xxxxxx, dated xx/xx2014, the keeper denies all liability to your company as it is an unlawful punitive charge, thus a penalty! If you reject this challenge the keeper requires within 35 days a popla verification code for them to appeal independently, per Version 3 of the BPA Code of Practice.

The vehicle and driver were entitled to be on site and we are not at liberty to disclose to outside parties reasons why. However, if you can provide contractual evidence to show you have a legal right to this information we expect you to include this in any reply.

The keeper has nothing further to add, and will not respond to any generic correspondence from your company unless it contains the popla code and the above mentioned contractual evidence, furthermore the keeper is fully aware that you must pay £27+Vat for this, so don't forget!

The challenge will be deemed accepted if there is no popla code on any rejection that you supply within the time-frame stipulated above.

Additional to the above, you may by now have noticed this is becoming something of a monotonous exercise. Whilst we can keep up this ridiculous exercise of responding to your harassment, you may find it more economical to add the relevant VRN to your whitelist again. I say again because it has already been supplied to Asda when previously requested.
  • Okay I have submitted my appeal using that recent template. I shall let you know their response.

Really appreciate all the help I'm getting here - you guys are great!

Did you get some proof of your appeal being sent just in case the PPC denies receiving it?

Do you mean the one in post 17?

If so, please say you edited it.

Its based on one I send to them regularly but with the last para added because its becoming tedious playing their silly games.

Let me say this. Since my first ticket from Town & City Parking over 4 years ago, which I paid as a greenhorn. I have handled 106 appeals to them on behalf of myself and others under both parking names, and not one has been paid and not one has been through POPLA. A strongly worded confident defence including points such as GPEOL, explanations about discounts and why charges are consistent despite the different breaches will bring a cancellation letter. SMART parking are becoming smarter by not wasting time on cases they won't win.
