Missed Chargeback Date, thinking of small claims?

I got a phone from Phones4u in january on contract, I was told to keep 6 months of bills and then I can claim back £105.00 When I went for a form yesterday I was told to go and ring them up, which I did, I was told on the chargeback form I was given I should have put the claim in, in april 13th,

I found the chargeback paperwork and yes I should have put it in on 13th april, I then had 60 days to claim, when asked why I didnt I was told I was misinformed by the staff at the shop,

Anyway I then had another chargback date of 13th july, but apparently if you do not put in your first chargeback date you lose the second one, so I have lost £210.00

The shop deny saying this, of course they would

So I was thinking of taking them to small claims court, what do you think my chances are?

Really annoyed at this,

I didnt look at the chargeback forms because I was told by staff that I wouldnt need to claim until 6 months were up!!

Any advise would be gratefully accepted :mad::mad::mad::mad::mad::mad:

    It's very unlikely a claim will succeed based on what you have told us.

    The case would be decided on the paperwork - not your word against theirs on who said what.

    Don't spend money on issuing a claim until you get some advice - it's free from trading standards departments.

    Most Trading Standards now use Consumer Direct for their advice line on 08454 04 05 06

    However if you phone your local TS during office hours they may transfer your call automatically or manually so you only pay for your local call and not the 0845 local rate.

    Like Quentin I don't think you will succeed in a County Court small claim unless you have some evidence of what was said in store.
