I suspect you'd be successful if you appealed now, as none of your arguments are driver dependent, but waiting is not going to harm your case. :)

You're forgetting the benefit of waiting, as well as the PPC tripping up, is that it costs them £2.50 for the DVLA search !

Does this mean I would have a higher chance of being dragged to court, if I waited for the notice to owner and replied, or if I replied now to the notice to driver?

Neither really. If you follow the advice you have zero chance of going anywhere near a court unless you fancy a game of tennis.

Not at all :) I stated clearly waiting is not going to harm. The point I was making was that none of the arguments for the appeal are driver dependent, so from that point of view it makes little difference. We all know the PPC's frequently trip themselves up though. You only have to keep an eye on Pepipoo, the Prankster, etc.... to know that. :T

It's been over a month since I got the ticket and I still haven't received a notice to owner. How long should I wait?

29 to 56 days is the correct timescale for POFA 2012 liability

Hi all, I finally received my parking charge notice earlier today, it says as follows:

On the --/--/2014 the terms and conditions which those entering the site agree to be bound by, were clearly displayed in prominent places within the car park. The vehicle was parked without authorization. and in accordance with the contract that was agreed upon entering, these terms were violated and therefore the parking charge detailed above is immediately payable.

I am pretty certain that the signage says that parking is allowed for 2 hours and that you cannot return for a further 2 hours so I don't understand why I got a ticket.

A few months back I got off a parking eye letter with a very long letter mentioning the following arguments.

    1)NO CONTRACT
    2)TRESPASS
    3)NO LANDOWNERS CONTRACT
    4)PUNITIVE, UNFAIR & UNREASONABLE CHARGE
5)UNFAIR CHARGE THAT EXCEEDS THE APPROPRIATE AMOUNT
    6)UNREASONABLE CHARGE
    7)GENUINE LOSS
    8)CAMERA'S

Should I send the same letter or should I add or takeaway any arguments?

    Danny

Hi,thanks for the replies, and yes I have read the newbies thread. It has a template letter to send to the parking company which I will use however I am pretty sure that they will reject the appeal. I was asking for advice on how to proceed with the POPLA letter. I'm sorry, I should have made that clearer.
