  • latest up date have managed to talk the wife into taking parking eye on we have wrote to 12 of the local shops and heard back of two that are going to look into it nothing of the others will keep you all informed as we go thanks again for giving us the confidence and help to take them on

    Overlooked interim advice :
    Write to them in postal form and obtain a certificate of postage :

    Offer them the opportunity to have the "dispute" dealt with by Alternative Dispute resolution with the outcome to be binding on both parties .
    The approved alternative dispute is POPLA.

    This has produced fruit at court already.
    You can then request the judge at the hearing suspends proceedings and orders the dispute to be dealt with at POPLA.
    As they will refuse your offer, trust me the judge will be furious with them.
    They still have to pay the agency of unemployable solicitors, so win win win.

    Refusal to take offer to resolute a dispute is a very good sneaky trump card to insert.

    I hope you have also emailed the landowner/retail park management themselves (usually easy to find by Googling the name of the place and reading the retail/advertising/newspaper article results).

    Hope you've read this one where the landowner cancelled TWO PE court cases when the victim sent a strong letter after the onsite retailer drew a blank in asking PE to drop their unwarranted £50 'offer' they always make when told to drop a case. Landowner stepped in, job done:

    Also read all the March links on the right by the Prankster, about PE. Plenty of Court cases won recently with the right arguments made. And technix's summary of what happened in their case:

    And the other transcripts on the Prankster's list are all worth reading because in some cases the defendants have an easy time - so you can see what can happen in Court. Normally it's a harder mater though involving legal information you must be ready to prove, as per the Prankster's Guide and all the exhibits you need to make a file of (court transcripts that support your case, pics of the unclear/unlit/misleading signage, email proof that the landowner wants it cancelled, etc. are all good evidence for you to gather).

    I will pm you a defence to submit now that you are well informed and more up for the fight!

    Also, have you got a picture of the signage wording on site? Is it the same as the wording in the PE v Lemon & Harris cases? Compare your sign's wording to the one torn into by the judge in those 2 cases. Does your sign use the same meaningless words: 'failure to comply with this?' Or if not, are any of the signs around the site different, and in another PE case won by the defendant, where one sign said £90 and another said £100? All those cases are in the NEWBIES thread post#5 small claims cases won (non exhaustive). See if your signs match any cases where the cases were won on signage issues.
