just recieved a parking eye court letter can anyone help please

  • I have sent them an email via the contact us thing few details to fill out then put the letter as a attachment to them saying I dispute etc

    You are NOT screwed, there is still hope & plenty of advice here! And if you just paid up what they are demanding that would be daft seeing as you may as well defend it and/or make an offer of £20 if so minded (or offer nothing and complain to the retailer/landowner - and if not cancelled, then see PE in court once you are well versed in all this). If you read other small claims threads by searching this forum and pepipoo forum you will find LOADS of outcomes from people (lots of threads on pepipoo parking forum about PE court cases and what happened).

    1. Please read the 'Small claims Court' links I put in the 'Private parking ticket? NEWBIES read these FAQs first' sticky thread at the top of this forum. You need to read the links there under the Small Claims Court heading, to see what happens when and to learn about all the victories by posters so far! There is lots of info there but not too much.

    2. Go ahead and acknowledge the claim online with MCOL saying you will defend in full (BUT NOT sending a defence just yet!). Do NOT 'contest jurisdiction'.

    3. When you have read the NEWBIES sticky thread links and the Prankster Guide, send me a pm over the weekend as I have a template first appeal I can send you. Lots of people use it but the main homework is yours because you will need to be ready for the N180 from (explained in the NEWBIES thread links) and be prepared with your court evidence, fully conversant with the issues to raise. And ready for their bluff and bluster 20 - 30 page reply to your defence, as mentioned in another PE thread today from someone who's further ahead in the process than you.

    4. Complain to the retailer if it's a retail site. And I mean, COMPLAIN to the CEO, immediately by email!

    Don't be scared of the word "court". Forget "Silk" and all those courtroom dramas. This is the small claims court which is very informal. There are no wigs or gowns with everyone just sitting round a table.

    So PE are taking you to court, and you want to pay them off to prevent it, why?

    On their present form they are consistently losing as judges are wising up to their abuse of the court system, and their unwillingness to produce contracts with the landowner, not to mention their little difficulty with a Judge in the Cambridge County Court.

    I would say that you are an odds on certainty to get a paid day in court, the last lady they took to court did not get to speak until the judge asked her how much money she wanted PE to pay her for wasting her time, so please put buying them off out of your mind, each case they lose is a further nail in their coffin.
    You never know how far you can go until you go too far.

    If someone wants to make an offer to PE they should start at £20, IMHO, not even think about just paying the stupid amount demanded in the claim. An offer is an option but of course you STILL have to defend the claim otherwise you will just lose by default if you don't follow the court process online as well as writing to offer a small settlement.

    I'm not saying you should pay or offer anything - personally I wouldn't, certainly NOT this early on, seeing as you 'could' pay them off at any time before court so why not try some other strong options for a few weeks ? I have seen so many other outcomes posted; e.g. people winning in court, people getting it cancelled by retailers so there is no hearing, and people occasionally making a small offer as well as defending and see what pans out.

    You'd be best to read lots of other threads about people defending PE claims - and you'll find the bulk of cases on pepipoo here, have a read of some and go back a dozen pages:

    And, do read the latest pepipoo link I added to the PE v Rickard thread (one of the many PE cases won by defendants, as shown under the Small Claims heading in the NEWBIES sticky thread at the top of the forum). It's a great thread about a letter from PE that's bothering 'Fistral Dude' the poster in question...!

  • highflyer, I can understand your wifes reluctance, Mrs Pecheque was exactly the same. The simplest and easiest way is to either pay up now, or ask for mediation. They settle for anything between 15 and 100 quid.

    Most people go through life paying their bills, getting along with others, and not having much to do with the legal system. After all, a robust legal system is designed to keep people out of court.

    Then one day, you get an official looking document through the letterbox, with all the leagaleze designed to frighten you. And Jo Average, just pay up to avoid the hassle.

    This happened to us, and we were keen to settle, but the more you look into things, the more you realise what a whole load of shenanigans are taking place.

    If you decide to fight, and no-one would blame you for not fighting, you will get loads of advice and support from here, and other sites containing a whole community of extremely brassed off people. I personally used Parking Pranksters guide, which was brill. Parkingcowboys also sum up the legal issues succinctly, its a good place to start.

    I think what really brasses people off, is all the stuff PE send through the post, questioning your integrity. (At one time, they were questioning my wifes eyesight).

    One of our points of defence, was that the Parking Eye signage was placed in an area known for snakes (there were warning signs telling you to avoid the area.) This was PE's reply..

    Please follow the advice from coupon mad and dont forget that parking eye are agents of the car park owners acting for them and on their behalf.
    Who's car park were you parked in? further advice may be available in helping you to get in touch with the car park owners and how best to proceed to get them to call off their dogs ( parking eye )
    dont forget the car park owners can call this off at anytime.

    but at the same time do not take your eye off the proceedings that parking eye are trying to commence.

    Hi there. Don't panic - there are lots of great people on this forum willing and very able to help. Do go to the retail park, especially if you can produce any kind of evidence that your wife bought something in one or more of the shops. Hassling bona-fide customers isn't good business practice, and I managed to get my parking charge (it's not a fine, btw) cancelled by one of the stores on the site. It's well worth doing that - it could nip all this in the bud. And ask for the landlord's name (landlords of the retail site). Some shop managers are very cagey about revealing this, though goodness knows why, but it's worth a go. And did I say don't panic? that's what PE wants you to do. Remember, too, that in the end, if it all gets too much, you can just pay uup - but I'm betting you'll get mad and want to get even way before that. Good luck! We're all rooting for you.
