Sorry I lost it a bit yesterday. needed to get out for a meeting and was a bit rushed.
What will the debt collectors yelling on one sidde and me going on the other... Oh dear
Rog suggested that you got some independent advice from one of the debt charities rather than relying us amateurs. Theese are CCCS, Payplan, National Debtline and CAB. Well CCCS_Mathew and CCCS_Emily have just been allowed to register officially. So it might be worth find one of them an asking them to look at your case.
Then you can have some impartial advice. If you've have not made a mistake, you've made nothing0 -
i sent the number telling them to remove my phone number, i am just going to sit and wait and see what happens.
not going to let them get me in a state of panic it not worth it, at the end of the day the worse that can happen is it goes to court and i arrange payments that way...
i dont think they have the paperwork i need to see, when next wednesday gets here if they have not sent the paperwork do i send a reminder letter ??? does anyone know what i should put in this letter if i need to send another0 -

AIC CASE NO.: *******
OUTSTANDING BALANCE: *******
Dear ************
We have been unable to come to an acceptable arrangement with you regarding the repayment of your outstanding balance. This has left AIC with no other alternative but to recommend that our Client initiate further action against you.
This could also result in further costs being added to your account and damage to your credit status, which could affect your ability to obtain credit in the future. This is your last chance to work together with us to prevent this from happening.
It is in your best interest to come to a mutually acceptable agreement. Therefore please contact our offices on the telephone number below to discuss the matter further. Alternatively you can complete the enclosed financial statement and return it to our office within 7 days of postmark together with an offer of payment and remembering to include your first instalment. To ensure immediate credit to your account you must write your AIC case number on the back of any cheque/postal order/bankers draft and also return a copy of this letter with your remittance.
If you are unable to pay please call us on the number below to discuss any alternative methods.
No further warning will be provided to you and you should therefore be aware that this is the final opportunity to resolve the matter with AIC.
Yours sincerely

Hi kurjam - I know it is difficult, but my advice would be to ignore the letter. In the unlikely event of it going to court, then you should produce documentary evidence of your requests for CCA and the judge will give CIA a taste of their own medicine.
If, as previously advised, you are talking with one of the Debt Counselling Charities, show that letter to them, and take their advice.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

i am not talking to a debt counselling charity is it worth me ringing them ??
and who should i phone who wouldbe best ??
do i contact cia about the cca as it 14 days +2 tomorrow ??
or do i just wait another 30days ??
when do i contact office of fair trading ??
thanks for any help !!0 -
Kurjam
Frankly this is outrageous.
However, given the vague threat of further action, I suspect what this means is that they do not have the documentation to back up their claim that you owe them money. So they think that being nasty may frighten you into coughing up.
If they do not produce the CCA and letter of assignment by tomorrow then they cannot pursue you through the courts for this. We will find a letter that you can send reminding them of this (another weller special) but I think we need to beef that up with reference to a few of the regulations that they are breaking.
After another 30 days, you can write to them and advise them that they have been extracting money without the legal right and they have to pay you back anything you have already sent them.
Since the debt is in dispute, they are breaking the rules writing to you in this manner anyway, so I would be inclind to talk to Trading Standards on the phone today. Get a photocopies of the letters they have sent and wait until Thursday. If there is no CCA, then that will boost your complaint, so it is worth waiting until then to send the documentary evidence.
Will check re the Financial Ombudsman as well.
Keep your chin up.If you've have not made a mistake, you've made nothing0
