i thought this was a simple matter..

    1) ask top flat guy..is this parking space your and in your lease agreement.

    2) ask bottom flat girl.is this parking space your and in your lease agreement.

    who ever says NO..problem solved..

    Nope.

People who have lived in places for ages normally can't find their lease and some people go mental over parking spaces. Plus this guy sounds a bit nasty.

    Quite right:

I would avoid confrontation with this guy if he seems aggressive. Try and get together as a group to sort out. Personally I wouldn't take the decision lightly to deliberately park in what he is convinced is his space until the matter is resolved.

If you have a lease and it depicts your interest clearly on a plan then you have exclusive possession of that space for the lease term. This means you can do what you want with it within reason. If you live in a busy London area then consider putting up some wheel clamping signs and instruct a firm of wheel clampers to remove cars which are not authorised on your space. That will soon sort old big boots out from upstairs. Out of mere courtesy advise the landlord what you are doing and why.

Sad but true - people do get funny about parking for some reason. I had an agreement with a neighbour to use their space, and someone else butted in and told me to go away in a not very polite fashion, even though they didn't have a car?! When I moved it, the next day someone dumped a car there and set fire to it, it sat there for a year before they had to pay to get it shifted :rotfl:

the solution is some kind of barrier, but try and reason first. At least forewarn of your plan as well, don't antagonise him, esp as he lives above you. I'm sorry for your woes!!

Thanks for everybody's support, its really made me feel better. Yesterday we spoke to the guy on the ground floor, he was very matter of fact about it and said that if its not in his lease its not his space, and that should be the end of it. So we've arranged to get together tomorrow night to try and sort it out amicably. I hope this works. He did say that he didn't know if the guy upstairs would even show up though, as he's a bit nutty. The sisters car is still there today. Cross fingers for tomorrow!

    Good luck for tomorrow!!

If an amicable agreement can't be reached, then you should state that you will be contacting the freeholder, as he/she will know who the 3 places belong to, and then will request the freeholder to mark the parking spaces.

Parking spaces are like gold dust in many areas, and can add ALOT of money to a property when selling it, so it's important to find out who owns which space. At least you know you have a space in your lease!! If it is the miserable guy that owns the parking space, I suppose he could offer to rent it to the other girl if there's limited street parking.
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

Would be odd if ground floor doesn't have a space - it's the obvious one to have one as more saleable to elderly/disabled/those with a kid. Bet top floor -attic conversion *is* the one without a space...

Sounds logical, but in our conversion, the top and middle floors have a parking space - the logic of the builders was that the bottom ones had gardens, so it all evened out. Go figure.

But we have got two cars, hence me renting one from the flat next door (greedy I know :o )

Good luck and keep us posted!

Wow....the two bedroom flat with parking AND a garage that we sold two years ago for £85500 would have been wiorth a fortune where you are!

I hope you can get it sorted out - as you say, the flat without the parking space in the lease is the one without parking. Simple, hopefully.
