    Hi I just want to wish you loads and loads of luck. I don't know much about these things but hope that you and your family get a nice judge that will be fair.

    I urge you to ring the National Debtline, they are a charity that deals with all things money, similar to CAB. They will guide you on what to say and what to expect. You may have to ring a couple of times before you get through but when you do they will give you the best advice that can be given and are very supportive and sympathetic.

  • Good luck for tomorrow. I would be scared too, but try not to be. Follow all the good advice you've had on here and it will go better I'm sure.

    Firstly may i ask how the 30k you owe Nat west was done,ie was it an unsecured debt or did you garantee it.I think i can help but need this information to procede.

    Hi - you said that your OH cannot speak.

    At the beginning of the hearing declare that he is a 'litigation friend' which means as long as the judge agrees, then he can speak for you.

    Other than that, have everything available for the judge and write down everything, even if it means you end up reading off a script.

    The amount the bank are requiring 30k how did that come about was it an unsecured loan,overdraft or was it garanteed,Also do you have other unsecured creditors,very important that i now that to give you advice i should be able to help you.

    If you haven't been able to get advice or someone to go with you tomorrow I'd recommmend getting to the court early as they may have a duty solicitor who can speak on your behalf. Your plan to sell and move into rented accommodation sounds like a very practical one. Is your house on the market at the moment? I'd recommend taking all details of the evaluation, any offers you've had, number of viewers...etc. See if you can get an adjournment to sell the house within the next 6-12 months.

    If not, the charging order won't prevent the house being sold but it will secure your debt. In the meantime, a payment arrangement could be made to reduce the debt further or if no payment offer can be made at the moment it should atleast satisfy Natwest that their debt is secured and give you time to sell your house with no the need for no further action.

    I know courts are scary but Judge's are human like the rest of us. Stay calm and take deep breaths, write down everything you would like the Judge to know so that if you do find it difficult to speak you can hand it to the Judge. Otherwise, you can use them as notes. If you think you're going to cry, take lots of hankies, and take your time.
