Just some advice re mortgage in mine and ex partners name.
He is stalling on signing on paperwork over to me and I don't want to sell as if i get a new place can only afford a 1 bedroom instead of a 2 bedroom.
If I pay all the bills and i know I am not allowed to but have changed locks, is their a certain period where the flat will become mine if he has stopped contributing ?

Don't really get why you don't want to sell. I would have loved to keep my huge last house I bought with my ex husband, but we had to sell because we split up. I'm in a smaller house, he's renting a flat. C'est la vie.
So, am I right in thinking, you have a flat together with a mortgage and have since split up?
Are you both named on the mortgage? 50/50?
If so, will the mortage company allow you to take over that mortgage on your own? If not, he can't just 'sign it over'.
Do you have any children with him?
No, it won't just become yours. No, you shouldn't change the locks (changing them certainly won't make it any more yours than it is now - presuming you both own it).

because I changed the lock and it hurt his feelings lol and he had an affair with some old woman at work and i think its going pear shaped and reckon he thinks he can just try and get back with me! yuk!!0

I want the flat because its a 2 bedroom for what you can only now get for a one bedroom so can afford it on my own with a lodger , happy to pay him the equity and also cut out as much solicitor fees as possible.0

Trouble is though its half his property and so would have the right to be there.
What kind of equity is there in the property? would he need to be paid in recognition of this value..0 -

Apparently he reckons he owns 51 percent and me 49 per cent but cant see this on any paperwork.0 -
Got a valuer coming although put on hold till he goes to CAB. Equity about £7000.00
I think I will get a loan to pay him off, as want a clean break.

You will need to have the mortgage in your own name to fully remove him from the property and title deeds.£2 Coins Savings Club 2012 is £4

You'll have to get him off the mortgage and deeds, that means a new mortgage.
It also means you have to meet the new criteria for that mortgage in terms of salary and deposit on your own.
If you split the equity 50/50 does that give you enough to cover the deposit? If not do you have any savings to make up any difference?One by one the penguins are slowly stealing my sanity.0
