Government consultation on ADR for consumers: BPA is "surprised and disappointed".

"There are some well established schemes in regulated sectors where the use of ADR is compulsory, such as the Financial Ombudsman Service, but in other areas such as passenger transport, water, construction, private parking, and vehicle repair, access to ADR remains patchy or limited."
The BPA said:
"The British Parking Association (BPA) is surprised and disappointed that Government does not recognise the work being done by the Parking on Private Land Appeals service (POPLA), the independent appeals service established for the private parking sector."
At least someone in government (albeit not the DfT) recognises that PoPLA is a steaming pile of ordure. I encourage everyone to respond to the consultation, and to cite PoPLA as an example of a voluntary ADR scheme that doesn't work.

I agree with you, said from the start they are not fit for purposeWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

As ever, the BPA do not understand the words put in front of them.
Its says Fininacial Ombudsman is compulsory in their area.

If we to have this evil amongst us, I would like to see appeals to the parking company withdrawn, they cannot be impartial, and they reject most of them in any case, and lets face it they abuse it for their own ends, losing post bull###t!
If there is a next incarnation of Popla, they should handle all appeals, the decision be binding on both parties, and the appeals should be based on the BPA Code of Practice, and Contract Law strictly, mitigation should be considered in certain circumstances, like if its a fluttering ticket.

Dont forget that the British Parking Association Limited to whom you refer to is a trade association whose core purpose is to further the aims of the parking industry, so that its member parking companies ( and councils who are also members ) can make more money.CAB then referred me to the British Parking Association. All this AOS/approved operator scheme, COP/code of practice is nothing more than a means to an end - to encourage the politicians and the DVLa that the parking companies are good honest bushiness who should be allowed access to the DVLAs registered keeper data.
and the CAB by and large takes its advice/information from the BPA ltdFrom the Plain Language Commission:

I spoke to the financial ombudsman today regarding the way my parking fines are being handled...they referred me to the government ombudsman...the government ombudsman referred me to citizens advice bureau...CAB then referred me to the British Parking Association. None of these bodies appeared to be able to offer any helpful of legal advice regarding private parking companies legal rights & the respective private debt collection agencies they employ.
