Hypothetical Accident, who would be to blame

    On a German motorway at night, in a queue behind an accident blocking the carriageway, with cars split to right and left as there's no hard shoulder, I saw someone do this, but worse

    There were already a couple of ambulances and 2 or 3 police cars ahead at a scene about 100 metres ahead, then another police car came between us.

    The traffic started to move very slowly as one or two cars crept past the scene at last, then a BMW X3 came down the centre and actually scraped against 4 or 5 cars behind me. I could see the jolt from the headlamp beams, and someone's wing mirror fall off.

    I pulled across to block it doing the same to me, at which point the horn was on continuous blast.

    I got out and asked the driver if he was the police, or a doctor. No. Then clear off, I said, just as half a dozen other drivers came up to confront him.
