Recouping money after split

If an ex did a favour for you which involved he or she paying for something you couldnt afford, can they then ask for the money after you've split up?

    It depends if they can show that it was officially a loan rather than just a gift.

    Outside of that then depending on if your married or not etc then the debt (if any) and the asset are just part of the pot that needs to be divided between the parties.

    They can ask, but whether there's any legal entitlement to being repaid depends on what was said or implied at them time, in whose name the item or service was purchased, whether the item still exists and who is in possession of it etc.

    The only way they could try to get it back (if you say no) is to take you to the small claims court. To be in with a chance of winning they would need to be able to PROVE that it wasn't a gift, and that you had a greed to repay it. This would be very difficult, so I wouldn't worry too much about it.

    Are you looking for legal advice or moral advice? They are very different in this case.

    Personally, I think you should repay money that was used for things like repairs. That person (ex or oterhwise) did so as an act of kindness to you, to make your life easier. It seems churlish therefore not to make some attempt to repay that, even if its a fiver a month for all eternity.

    But I don't think that's what you want to hear!

    Thanks Rottensocks. However on the basis that I have helped him out and not charged him for it, I dont really feel any moralistic guilt. Surely that's what relationships are all about?
