is that legally binding now?
Thinks maybe the delay is this being reffered back to corporate to find out how to proceed, lets hope they get an answer today as all shut tomorrow for 4th July in US!
Checked with bank and they confirmed funds have been claimed and not just "ringfenced"! so they have taken the funds an created a contract as far as I can see.Over 100k miles of Electric Motoring and rising,0 -
order is still there and taken my money but no confirmation email - is that legally binding now?
This happened with a Debenhams misprice I tried a while back. The money was taken, emailed and written order confirmations were sent out, and as far as I remember estimated delivery dates were provided too. Debenhams then sent out letters a week later saying that their suppliers couldn't supply the item and so the order was cancelled and money refunded. As far as I know no-one on here succeeded in getting them to supply the item or an equivalent at the same price, so my guess is Apple will also argue that they can't get the stock required to honour the orders, and I very much doubt there's anything we'll really be able to do.
...other than take our refunds, check if our quidco still gets paid, shrug our shoulders and admit that we didn't really expect to get them anyway!0 -
Rang apple a while ago and was told the misprice would not be processed. Their postion was it was a misprice blah blah blah.0

Just one question. Why are they taking the money? Mines gone from my bank account. Surely they should take money once order is processed, not before.
The stock issue is neither here nor there, it's showing as avaliable to ship in 24 hours.
If someone has rang and been told it's a misprice and thats that, they should not have taken money and should have informed us by now.
I have ordered loads of misprices, near 100. Dell always send or have with me. Never have I had the money taken though.
I'm not all for this 'lets sue them' business. But this misprice has gone further than any I had before, as in they had a full business day to sort it and havent, and have also taken the money, as in actually debited it.
It's now like seeing a misprice in tesco's, paying for it and then them taking it off you as you drive out the car park.0 -

Read the T's and C's if you are not happy with them then do not order...5. Paying for Your Products
5.3 If you are paying by credit card, then you must supply your credit card details when you place your Order. Your credit card will be charged when we issue your Invoice or on shipment of your Products. We will not commence the manufacture of your Products neither will we supply the Products to you nor perform the Services until your credit card issuer has authorised the use of your card for payment of the Products and/or Services ordered. If we do not receive such authorisation we shall let you know. Your credit card billing address must be in the mainland United Kingdom, Northern Ireland or the Isle of Man.
Also this is stated regarding pricing errors so do not get your hopes up. If you do receive the Disk then it is in good faith from Apple.2. Placing Your Order
2.6 Whilst we will make every effort to supply you with the Products listed on the Order Confirmation, there may be occasions where we are unable to supply these Products because, for example, (i) such Products are no longer being manufactured or available or (ii) we are unable to source relevant components or (iii) if there was a pricing error on the Apple Store Web Site. In such circumstances we will contact you to inform you and may suggest alternative Products that you might wish to purchase. If you do not accept our suggestions then we will cancel your Order in relation to those Products we cannot supply and repay you any money that you may have paid to us in respect of those Products. Subject to clause 11.4 below, repayment of such monies will be the extent of our liability to you if we are unable to deliver to you the Products you have ordered.Man who stands on toilet is high on pot. - Old chinese proverb.0
